Forest Service Plan of Operation Approval: Under the Memorandum of Understanding <br />between the USFS and the Division the Division will not issue a mine reclamation permit <br />until the Operator has an approved USFS Plan of Operation. The Division considers an <br />approved USFS Plan of Operations as legal right to enter and to conduct and mining and <br />reclamation activities on the site. Without an approved PJan of Operation the Division <br />would not have proof of a legal right of enter, and would be required to decry the Division <br />reclamation permit. If the USFS approved Plan of Operations cart not be obtained be the <br />June 1", 2006 decision date, you may want to provide the Division with a waiver of the <br />decision date allowing you time to obtain the USFS Plan of Operation. <br />Understood. I will request an extension to allow the USFS further time for making its <br />decision. <br />In addition under the Memorandum of Understanding between the USFS and Division, <br />the USFS can provide input on the bond adequacy. This is sign~carrt if the draft Plan of <br />Operation were to change between the issuance of the Division reclamation permit and <br />the approval of the Plan of Operation. Those changes could impact the adequacy of the <br />Division calculated bona Also tf during the review process the Draft Plan of Operation <br />were to change, it could impact the finding of consistency (see above), and require the <br />Operator to submit a Technical Revision or Permit Amendment to the Division <br />reclamation permit. If the changes to the Draft Plan of Operation are made while the <br />Division application is still in review, arty changes to the Division application could be <br />more easily incorporated <br />Understood. <br />
