<br />Resolution 1 1987-30 • <br />Page 2 <br />1. That the applicant canply with all requirer~ents of the PAined <br />Land Reclamation Board Section 112 Permit an~ all applicable <br />statutes and regulations of the Colorado Mined Land <br />Recl?rnation Act. <br />2. All extraction and processing operations on the site shall be <br />located in the areas designated in the D7ined Land Reclamation <br />Board Application. Gravel/mineral extraction and processing a <br />operations shall be conducted in such a manner as to not <br />create a nuisance to the public or surrounding properties and <br />shall not create any unreasonable disturbance to residents in <br />the surrounding area. Operator shall mitigate any adverse <br />environmental impacts of the extraction and processing operation <br />including specifically fugitive dust, other particulate air <br />emissions, noise, vibration and odors, so as to not unduly <br />impact surrounding properties. The extraction and processing <br />operations shall be in compliance, at all times, with applicable <br />state and local health department regulations and requirenents <br />for air particulate onissions and noise abatement. The normal <br />hours of operation shall be from 7:00 A.M to 6:00 P.57. Monday <br />through Saturday. The operator may go to sixteen hour/day <br />operations fron 5:00 A.D1, to 9:00 P.17. as onergency hours only. <br />3. That the applicant obtain any required permits from the County <br />Road and Bridge Department prior to operating the pit. <br />4. The mall trees closest to the access road on the North side be <br />removed to improve siglrt distances along the County Road. <br />S. All verbal and written representations of the applicant shall <br />be deemed to be conditions of approval, except to the extent <br />they are modified by the specific conditions in the resolution. <br />6. Periodic Review and );hforcenent: This land use approval is <br />expressly contingent upon and subject to the operator's <br />receipt of and compliance with all required state permits or <br />approvals, including, but not limited to, the permit for the <br />proposed operation required from the Colorado P.4i~ied Land <br />Reclamation Board. Should the Colorado Mined Land Reclamation <br />Board or any other State agency, whose permit or approval is <br />required for the operation, suspended or revoke such permit or <br />approval for the operation, the County's land use approval <br />shall be deemed suspended or revoked, as appropriate. Any <br />written allegations that the operation is in violation of the <br />terms and conditions of approval shall be referred to the <br />County Planning Staff for investigation. The County Staff <br />shall pronptly investigate any such written allegations con- <br />cerning violations and report their findings to this Board. <br />
