That the applicant canply with all requirer~ents of the PAined Land Reclamation Board Section 112 Permit an~ all applicable statutes and regulations of the Colorado Mined Land Recl?rnation Act. 2. All extraction and processing operations on the site shall be located in the areas designated in the D7ined Land Reclamation Board Application. Gravel/mineral extraction and processing a operations shall be conducted in such a manner as to not create a nuisance to the public or surrounding properties and shall not create any unreasonable disturbance to residents in the surrounding area. Operator shall mitigate any adverse environmental impacts of the extraction and processing operation including specifically fugitive dust, other particulate air emissions, noise, vibration and odors, so as to not unduly impact surrounding properties. The extraction and processing operations shall be in compliance, at all times, with applicable state and local health department regulations and requirenents for air particulate onissions and noise abatement. The normal hours of operation shall be from 7:00 A.M to 6:00 P.57. Monday through Saturday. The operator may go to sixteen hour/day operations fron 5:00 A.D1, to 9:00 P.17. as onergency hours only. 3. That the applicant obtain any required permits from the County Road and Bridge Department prior to operating the pit. 4. The mall trees closest to the access road on the North side be removed to improve siglrt distances along the County Road. S. All verbal and written representations of the applicant shall be deemed to be conditions of approval, except to the extent they are modified by the specific conditions in the resolution. 6. Periodic Review and );hforcenent: This land use approval is expressly contingent upon and subject to the operator's receipt of and compliance with all required state permits or approvals, including, but not limited to, the permit for the proposed operation required from the Colorado P.4i~ied Land Reclamation Board. Should the Colorado Mined Land Reclamation Board or any other State agency, whose permit or approval is required for the operation, suspended or revoke such permit or approval for the operation, the County's land use approval shall be deemed suspended or revoked, as appropriate. Any written allegations that the operation is in violation of the terms and conditions of approval shall be referred to the County Planning Staff for investigation. The County Staff shall pronptly investigate any such written allegations con- cerning violations and report their findings to this Board.
