Environmental Assessment Bowie Resources, L.L.C. <br />' August 2005 Spruce Stomp Federal Coal Exploration License (150- 2005 -43) <br />Administrative <br />' 1. The Licensee shall notify the Paonia District Ranger at least one week before operations <br />are to commence on NFS lands. The District Ranger must also be notified 48 hours in <br />advance that heavy equipment would be moved onto NFS lands and that surface <br />' disturbing activities would commence. <br />2. The USDA -FS must be notified of any proposed alterations to the plan of operations. <br />' Any changes to the existing plan are subject to USDA -FS review as additional conditions <br />may be required. <br />3. Prior to any surface disturbing activities taking place, the alignments of roads and drill <br />pad locations would be approved in the field by the Paonia District Ranger. <br />' 4. All surface disturbing activities, including reclamation, must be supervised by a <br />responsible representative of the Licensee who is aware of the terms and conditions of the <br />projects permits/licenses. The Licensee would have an authorized representative on site <br />' at all times. A copy of the appropriate permits/licenses must be available for review at <br />the project site and presented upon demand to any USDA -FS official. <br />t 5. All areas used to stage or store equipment and/or supplies would be pre- approved by the <br />Paonia District Ranger. Reclamation of these areas may be required and would include, <br />but not be limited to, re- seeding, disking, etc. <br />6. The Licensee and/or their contractors must have the necessary materials on hand and <br />immediately available to contain any spills of fuels, oil, and other contaminants. Any <br />spills must be reported to the USDA -FS immediately. Immediate containment and clean- <br />up would be required consistent with the Licensee's Spill Prevention, Control, and <br />Countermeasures (SPCC) Plan and/or other applicable requirements. Any contaminated <br />soil would be removed from the Forest prior to reclamation. <br />Access and Road System <br />1. The Licensee would be required to obtain a Road Use Permit (RUP) from the USDA -FS <br />prior to any activity on the SSCEL. Roadwork would be performed only upon <br />authorization of the District Ranger, and would follow construction specifications <br />identified by the USDA -FS. New roads would be designed and constructed to provide <br />maximum stability and protect the surface resource. All roads would be maintained or <br />constructed to NFS specified standards for either temporary or classified roads, as <br />appropriate and approved by the USDA -FS, with a design speed appropriate for road type <br />and condition. The Licensee would be required to abide by NFS seasonal road closures. <br />2. Unauthorized off -road vehicle travel is prohibited. <br />3. All new roads would be closed to public motorized use. The Licensee may be required to <br />post signs to this effect at the direction of the USDA -FS. <br />2 -6 <br />
