Therefore, your client will be required to <br />submit a bond to cover the cost of reclamation. <br />In order to expedite the review process, an adequacy review of the <br />NOI was conducted concurrently with the completeness review. The <br />Division's comments and concerns are as follows: <br />1) On page 2 of the application, the township is listed as ~J'-- <br />"TSN." The Division assumes this is intended to read, <br />"T5N." Please make the appropriate correction. <br />2) The NOI indicates that Cottonwood Land Company is the <br />owner of record far the surface at sites A, B, C, D and <br />E. Please indicate specifically where the ownership is <br />recorded. <br />3) Please indicate who owns the mineral rights at the ~2" <br />proposed exploration sites. <br />4) The proposed sediment control method for the topsoil <br />stockpiles is inadequate, because it will not control <br />runoff from the topsoil stockpile itself. Preferable <br />sediment control measures would include a totally <br />enclosing berm or silt fence around the stockpile. .t <br />5) Please indicate what sediment control measures will be U't`. <br />taken to control runoff from the drill pads. <br />6) The description of the proposed well completion methods <br />states that a bentonite plug will be place above and/or <br />below the screened interval to prohibit vertical <br />migration and cross contamination of aquifers. This <br />description leads the Division to believe that some wells <br />may be completed without a bentonite plug above the <br />screened interval. It is customary to place a bentonitei~ <br />seal above the filter pack to prevent cement grout from <br />infiltrating the filter pack and possibly interfering <br />with the flow of aquifer water into the well. The <br />Division strongly recommends that the operator place a <br />bentonite seal above the filter pack in each well to <br />ensure the integrity of the well. <br />7) The Division has estimated a reclamation bond liability <br />of $42,734 compared with your estimate of $39,573. The <br />Division's calculations are enclosed for your review. <br />
