Three determinations concerning the Notice have been <br />made: <br />1) The Notice of Intent (NOI) was found to be incomplete. <br />The following items need to be submitted in order for the <br />NOI to be called complete: <br />a) Right-of-entry documentation is needed for <br />sites F and G. The Division will consider <br />stipulating this requirement if right-of-entry <br />documentation is not available at the time <br />that the rest of the sites are approved for <br />drilling. <br />b) Threatened and Endangered Species clearances <br />as required by Rule 2.02.2(2)(h) are needed <br />for the proposed exploration area. The <br />Division will consider stipulating this <br />requirement, if clearance is received for some <br />of the sites but is delayed for others. <br />However, the NOI will not be approved until at <br />least one site has all the clearances needed <br />for drilling. <br />2) The project qualifies as coal exploration rather than as <br />coal mining. <br />
