The Division received correspondence from the Office of the State Engineer (OSE) dated September 22, 2004
regarding the East Rigden Pit Subsfitute Water Supply Plan, Permit No. M-1979-097. The letter states that,
"Mining has been completed at the East Rigden site and construction of a clay reservoir liner is proceeding in
the southeast portion of the property." See attached letter for reference.
The Division's initial review of the East Rigden pernut does not account for a clay reservoir as a component of
the reclamation plan. Please be aware that Lafarge must revise the East ltigden reclamation plan if a clay-lined
reservoir is anticipated. Converting groundwater lakes to lined reservoirs may require the filing of a permit
amendment. Failure to revise the pemut maybe considered a violation of the East Rigden Permit, the Colorado
Land Reclamation Act for the Construction Materials and the Construction Material Rules and Regulafions.
