The applicant states on page 13 that the overburden will be <br />stockpiled along the perimeter of the azeas to be mined and ultimately used in reclaiming and <br />sloping the shoreline. Please indicate the approximate volume or percentage of total overburden <br />produced that will be used for the following: a) raising the elevation of the 9.5 acre Pod 5 <br />Processing Area, b) backfilling the 7 acres of wetland bench areas to finish contours, and c) <br />backfilling and grading the 15, 1561ineaz feet of shoreline. <br />7. The applicant states on page 16 of the application that they are in the process of applying for a <br />well permit and required temporary substitute supply plan to augment evaporative loss from the <br />mining operation. Please indicate if approval of either well permit or TSSP has been granted <br />from the Office of the State Engineer (OSE). If not, please commit to obtaining approval of all <br />required permits from the OSE prior to exposure of groundwater and/or dewatering at the <br />Milliken Site. <br />8. The mining and reclamation plan is designed to create a seriess of~ mining plan and Mining <br />Plan Map, Exhibit C does not contain any information regarding the design and construction of <br />the reservoir liner. In order to demonstrate compliance with Rule 3.1.6 of the Construction <br />Material Rules & Regulations the applicant will need to provide [he Division with one of the <br />following items: <br />A) A copy of the SEO's letter approving the proposed liner design and a copy of the design and <br />specifications for inclusion into the applicant's application prior to the Division's <br />recommendation date. <br />B) A commitment to stay at least two (2) feet above the high water ground water level and an <br />adequate means to monitor compliance until such time that written approval from the OSE for <br />the liner design and specifications is achieved. <br />C) Provide a financial warranty adequate to cover the cost of backfilling the pit to an elevation <br />[ha[ is at least two (2) feet above the high ground water elevation. <br />
