Walther <br />Execwrve Director <br />Michael B Long <br />Division Duecror <br />RE: Division Recommendation, All Rite Paving and Redi-Mix, Inc., North River Pit, 112 <br />Permit Application, File No. M-99-005 <br />Dear «Suffix» «LastName»: <br />The Div;sion has fouL7d that All kite Paving and Redi-Mix, Int.'s application for the proposed Ncrth <br />River Pit 1 12 permit meets [he requirement of the Colorado Land Reclamation Act for the Extraction <br />of Construction Materia]s C.R.S. 34-32.5-101 et seq. and the Board's Construction Materials Rules and <br />Regulations. In accordance with Rule 1.4.5(6), the Division is informing you that our recommendation <br />to the Colorado Mined Land Reclamation Board is that the application be approved, with the financial <br />warranty (reclamation bond) set at 554,700. The operator has satisfied the Division's remaining areas <br />of concern including groundwater quality, mining in potential wetland areas and reclamation to the <br />final land use, by committing to the following: <br />On site fuel storage has been eliminated from the mining plan. <br />An asphalt hatching plant has been eliminated from the mining plan. <br />An area of possible jurisdictional wetlands has been eliminated from the mining plan. <br />4. The operator has committed to not mine the sand and gravel resource until the necessary <br />approvals are obtained from the State Engineer's Office to expose ground water. <br />The following are lists of issues received by the Division during the statutory comment period from <br />persons objecting to the application. The Division's rationale for recommendation for approval over <br />objections will be sent to yoLl prior to the Pre-Hearing Conference, which will be held June 14, 1999, <br />in Room 318, 13 L3 Sherman Street, Denver, Colorado. Several conferences will be held that day. 1 <br />III IIIIIIIIIIIIIIII <br />STATE OF COLORADO <br />will inform you of the time as soon as it is determined by the Conference Officer. <br />
