<br />' 11. The policy of the County requires that maintenance access be provided to all storm drainage <br />facilities to assure continuous operational capability of the system. The property owners <br />shall be responsible for the maintenance of all drainage facilities including inlets, pipes, <br />culverts, channels, ditches, hydraulic structures, and detention basins located on their land <br />unless modified by subdivision development agreement. Should the owner fail to adequately <br />maintain said facilities, the County shall have the right to enter said land for the sole <br />purpose of operations and maintenance. All such maintenance costs will be assessed to the <br />' property owners. <br />I2. No mining shall be permitted within 400 feet of the South Platte River measured to the top <br />' of existing bank, or from the top of master plan bank, whichever is furthest away from the <br />river without approval from the Urban Drainage and Flood Control District. Said approval <br />shall be subject to the "Technical Review Guidelines for Gravel Mining R'ithin or Adjacent <br />' to 100-Year Floodplatns" as adopted in the Adams County Zoning Regulations. <br />13. No mining shall be permitted within 100 feet of the S. Platte River measures [o [he top of <br />existing bank, or from the top of master plan bank, whichever is furthest away from the river <br />without approval of a variance from the Urban Drainage and Flood Control District. In <br />1 addition, a variance shall demonstrate that [he applicant can guarantee that they can mine <br />and immediately reclaim the area within the 100 foot setback during one !ow flow season <br />(generally October through March). <br />1 Note to the Applicant.• <br />1. All conditions precedent must be satisfied prior to commencing operations on the subject <br />site. Proof that the concerns have been addressed will require a Notice to Proceed from the <br />Department of Planning and Development. <br />The application to the State under File No. M-99-034 was approved and all changes, conditions, etc. <br />that were agreed to during the process as was two (2) stipulations made at the ML1tB hearing on <br />07/27/99. These two stipulations are stated below and have been incorporated where appropriate <br />mto the Introduction, Overview and the Exhibits and also identified in italics printing by (DMG <br />S~). <br />1. EngineertngDestgtu, Specifications, aconstruction timetable, and a quality assurance plan <br />for the slurry wall will be incorporated into the permit via a technical revision prior to <br />commencement of the slurry wall. CAMAS Colorado, Inc. will provide the Division with a <br />coiutruction report, and a certification that the slurry wall was installed in accordance with <br />approved plans at the conclusion of the installation. <br /> <br /> <br />1 <br />
