d. Notify the Division in writing, within 5 days of completion, <br />of the date by which the solids in pond 003 were removed. <br />Include in vour response a description of the method of disposal <br />of the solids. <br />e. Notifv the Division in writing, within 5 davs of submittal, <br />of the date that the Technical Revision regarding construction <br />of ponds 005 and 006 was submitted to the MIRD. <br />f. Notify the Division in writing of the beginning date for <br />Phase II as soon as you become aware of this date. <br />g. Notifv the Division of the results of all monitoring of <br />outfalls 002 and 003 during Phase II, verbally within 2 working <br />days following the close of Phase II and in writing within 5 <br />working days following the close of Phase II. <br />h. Notifv the Division verbally within 24 hours of becoming <br />aware of anv TSS result during Phase II exceeding 70 mg/1 and/or <br />any dissolved aluminum result during Phase II exceeding 0.1 <br />mg/1, for either outfall 002 or 003. <br />10. Perform an acute biomonitoring test, in accordance with EPA <br />protocol, at outfall 002 and outfall 003 during the third week of <br />Phase II. A second acute biomonitoring test will be performed once <br />the chemical treatment system is on-line and stabilized. The specific <br />date for the second biomonitoring test will be determined by the <br />Division with concurrence by MIRD. <br />Pursuant to section 25-8-603, C.R.S. (1982), you are required to <br />submit to the Division an answer admitting or denying each paragraph <br />of the Findings of Fact and responding to the Notice of Violation. <br />Section 603 also provides that the recipient of a Notice of Violation <br />may request the Division to conduct a hearing to determine the <br />validity of the Notice, including the Findings of Fact. Such request <br />shall be filed in writing with the Division. both the answer and the <br />request for hearing, if any. shall be filed no later than 30 days <br />after issuance of this Order.
