Typical areas of conce n are <br />direction and depth of mining, topsoil stripping and han ling, <br />method of mining (wet or dry pit), etc. <br />2. Given the fact that this operation has been moved to a 1 cation <br />adjacent to Mill Creek, several new areas should be disc sled. They <br />are as follows: <br />1a. What is the character of Mill Creek? That is, is it ephemeral, <br />V intermittent, or perennial in flow? <br />Ib. How will the creek be protected from sediment and of er <br />`vl potential disturbances due to the mining operation? A sediment <br />control system should be described (e.g., a berm and or sediment <br />pond system), and a commitment to an undisturbed set ack (e.g., <br />50') of mining from the stream should be made. <br />c. Can this pit now be expected to be dry, given the pr ximity to <br />the creek? If not, how will the operation work with a wet pit? <br />Will the pit area be dewatered, or will wet mining m thods <br />(e.g., a dragline) be used? Dewatering might requir an NPDES <br />permit from the Colorado Department of Health. <br />d. I note that the topsoil has already been stockpiled s close as <br />30' to the creek. Given the danger of loss of topsoil to <br />flooding, please submit a plan to protect the topsoil from creek <br />flows. This would involve either moving the topsoil to an area <br />on the other side of the permit area from the creek, berming <br />around the topsoil stockpile to a defined height to rotect <br />against a defined flood, or both. <br />\3. Any topsoil stockpiles left for one growing season or lon er should <br />v\ be planted with a perennial grass cover crop. One suggestion is <br />Western wheatgrass at a drilled rate of 16 lbs. PLS/acre. <br />4. What is the planned life of this mining operation? <br />Exhibit D <br />1.
