The Division of Minerals and Geology ("Division") shall not be a party, but shall participate in the hearing as staff to the Board. III. ISSUES TO BE CONSIDERED Presentations to the Board shall be strictly limited to the issue of whether the pending application complies with the requirements of the Colorado Land Reclamation Act for the Extraction of Construction Materials (Act) and the Rules and Regulations promulgated by the Board. The parties shall limit presentations to the question of whether the pending application should be approved or denied, based on the issues stated below: FOOTNOTES: (a) The text for each specific numbered item grouped to each major issue is attached to the end of this document. (b) Numbers succeeding statement of issues refer to those concerns raised at the informal conference regarding the Original Application and during the public comment period for the Amended Application. Numbers with the suffix "A" refer to concerns raised in reference to the Amended Application. Numbers with no suffix refer to concerns raised in reference to the Original Application. (c) Underlined text indicates changes made after the pre-hearing conference held in Canon city on March 16, 1998. 1. Do the proposed operation & reclamation plans minimize impacts to the prevailing hydrologic balance? 28A. la) Potential impacts to groundwater quality: 5, lA, 10A, 11A, 20A, 23A, 24A, 25A, 30A. lb) Potential impacts to surface water quality: 3, 6, 8, 15, 21, 2A, 6A, 9A, 30A,31A,32A,34A,35A,36A. lc) Potential impacts to existing ground water supplies: 7, 19, 20, 3A, 8A, 17A, 33A.
