Lesson make no <br />warranties of title to the Leased Premises, either expressed or implied. <br />6. Lesser Interest. If Lessors, az Co-Trustea by Virtue of Appointment by <br />the District Court in Delta, Colorado, August 9, 1976, own less than cone-fourth (1/4) <br />undivided interest in and to the coal in, upon or underlying the Leased Premises, thus <br />the production royalty provided for herein shall be paid to I-esson only in the <br />proportions which their interests bear to the whole, undivided ownership of the coal. <br />7. Conduct of Operations. Lessee shall wnduct all operations and maintain <br />all activities on the Leased Premises in a good, prudent and miner-like manner, in <br />accordance with normal, accepted industry standards, and in strict compliance with all <br />applicable governmental laws, regulations, licenses and permits, including without <br />limitation, those relating to the protection of the environment and reclamation of land. <br />Lessee shall be solely responsible for obtaining all necessary governmenr:.l <br />licenses, permits, certificates and other approvals for operations to be conducted upon <br />the Leased Premises and pursuant to this Lease. Dumps or stockpiles of waste, <br />overburden, or other materials produced from other lands may not be deposited on the <br />Leased Premises. <br />8. Records and Reports. Lessee shall keep books of account of the mining <br />and sale or other disposition of coal from the Leased Premises, such books to be of the <br />usual characte* kept by coal operators for such purposes, and which books shall be open <br />at all times to the inspection of the Lessors or their authorized representatives. In <br />addition, <br />Ltssce shall provide to Lessors the following: <br />(i) At leazt semi-annually, a summary report of the <br />status and conduct of operations hereunder, to <br />include a statement of intended operations for <br />the nett succeeding quarter. <br />(ii) Copies of drill and core logs, geologic data, <br />reports of sampling and testing of coal and coal <br />deposits, identification of drill hole locations, and <br />otner factual Grata (exclusive of interpretation) <br />obtained by Lessee which pertain to the Leased <br />4 <br />
