Box 125 <br />Norwood, CO 81423 <br />Re: Hawks Pit Application Incompleteness (File M-88-037) <br />Dear Ms. Gray: <br />The Division has received the Skelton, Inc. limited impact permit <br />application. The application has been reviewed and found to be incomplete. <br />The major items which remain nut standing at this time are the size, location <br />and acreage of the area which needs to be permitted under the Mined Land <br />Reclamation Act. <br />The Division's inspection of March 16, 19A7 revealed that there are two areas <br />of disturbance at this site. These are the Northern pit and gravel stockpile <br />area in Montrose County, anA the Southern mined area in San Miguel County. <br />These two mining areas are separated by the San Miguel County gravel pit, <br />however they are joined by an access road which is located to the East of the <br />mined areas. In addition, field ohservations indicate that both of the <br />Skelton disturbances utilize the same overburden and topsoil stockpiles. The <br />reclamation of the South mine area must he addressed since it was disturbed <br />without obtaining a permit from the Mined Land Reclamation Roard. It is our <br />opinion that the entire mine area (North and South pits, associated access and <br />haul mad s, as well as topsoil and overburden stockpiles) will exceed the 9.9 <br />acre limitation of a 110 permit. Therefore, we believe that a regular impact <br />(112) permit is necessary in order to bring this operation into compliance <br />with the Mined Land Reclamation Act. This opinion is suhstaniated by the <br />Mined Land Reclamation Act (34-32-112(1)), and the Mineral Rules and <br />Regulations Rule 2.1.
