<br />~ ~ ~ RESOLUTION N0. M.M 8 -170 <br />ADOPTING A DECISION ON REQUEST FOR <br />CONDITIONAL USE-GRAVEL EXTRACTION/AFT ZONE <br />BY W.R. AND W.T. HALL <br />Plannine Deoartment No. C36-83 <br />WHEREAS, W.R. and W.T. Hall sought to obtain a condi- <br />tional use permit for gravel extraction in the AFT Zone on the <br />following described land situated in the County of Mesa, State <br />of Colorado, to-wit: <br />That part of the SW'-LSE's and S`~SW'~ lying <br />South and East of the Orchard Mesa Canal No. <br />2, in Section 26, Township 1 South, Range 1 <br />East of the Ute Meridian; together with an i <br />easement for access over and across the South i <br />40 feet of that part of the SW'ySW~L of said ~ <br />Section 26, extending from the West boundary <br />line of the said SW~ySW`~ (being 32 Road), East ~ <br />to the West boundary line of the above described ~ <br />property. This easement may at the discretion <br />of the grantors, be used by others; it may not <br />be shared or conveyed by grantees, except to <br />their successors in title, or grantees, <br />licensees or invitees. The restriction upon <br />grantees to share or convey said easement, as <br />above defined, shall be void upon the grantors <br />conveying title to the said SW'~SW`~ to any third <br />party or parties. <br />and, <br />WHEREAS, the hearing before the Board of County <br />Commissioners of the County of Mesa was held. <br />WHEREAS, the Board considered the evidence presented <br />at the hearing and the zoning maps and regulations of the County <br />and FINDS: <br />1) That the hearing was duly held after proper notice. <br />2) Tha[ the Mesa County Planning Commission <br />recommended approval of the conditional use subject to staff <br />comments. <br />3) That the Planning Staff recommended approval <br />subject to: <br />(a) Paving the haul road from the Orchard Mesa <br />Irrigation Canal to 32 Road. <br /> <br />
