He was going to have him <br />excavate an area for a hay storage shed on the ridge above his house and <br />Jay would get the money from selling the Tc•ck from the excavation site <br />and that would keep him from losing everything. He assured me that the <br />everything would be done by October. Then at the planning commission <br />meeting on April 6th, Jay asks for a 10 ye:~r permit. They gave him a 5 <br />year permit and the County Commission on A~~ril 12 gave him a 3 year <br />permit, the Soil Conservation on April 14 recommended no blasting. 'This <br />was just to level an area for hay storage. I was left in the dark <br />wondering what happened to Ghe Original 6 months. You should see the <br />area now_ Tt looks like a new mountain ravage, and just for a hay <br />storage area. 2 hardly can believe they. <br />#2 Distance of the mine from the Spring. Ac the April <br />Zanning Commission and Soil Conservation meetings Jay said that it was <br />600 feet. less than 1/2 mile. That would be 2030 feet. At the April <br />County Commissioners meeting Jay stated that •`the spring ie within the <br />watershed but is about 3000 feet away`. F. letter from the soil <br />Conservation repor d that the spring is actually 1/10 of a mile away <br />Prom the site. (5~~ teed <br />#3 Nearest manmade structure. On February 23 on the <br />tiimited Impact Operational Reclamation ve~.~nic Apylicat ion Form it stated <br />4000 feet. On February 24 on the Constru::t ion Materials Limited Impact <br />Operational Fermic Application Form it et.ited 2500 feet. On the March 6 <br /> <br />letter to the Division of Minerals and Ge~~logy from Wagner it stated <br />none within 1000 feet and showed a map of the nearest structure which <br />was Siskups at 1310 feet. I think the nearest manmade structure is the <br />Apringbox which is i/10th of a mile as stated by the Soil Conservation <br />oT£ite. <br />~ Elevation of the Mine Site. February 23 permit <br />stated 7200 feet. February 24 permit staeed 6400 feet. April 6th at <br />the planning commission stated 6600 feet. That is a difference of 800 <br />feet. I triink it is about 6400 feet. <br />#~. Elevation of the Spring site.. At the County <br />Commissioners meeting it was stated that the elevation of the spring was <br />6204 feet. That is completely wrong. Lc+ok at the map and you will see <br />that Highway 394 is 6204 feet. AC t:ze County Commissioners meeting <br />he said that the site will be reclaimed. The same letter Exhibit B <br />regarding site description states no str yams, springs, etc. that will <br />receive drainage directly from the permit area within a 1000 foot <br />radius. The spring is less than 1000 feee~ xava berms been made to <br />control the drainage./Exhib it C states the mining will end when <br />necessary excavation has been completed to satisfy the requirements for <br />construction of the hay storage area. Pgain my question. How long does <br />it take co excavate a hay storage areal Lets tell the truth, this is <br />not a hay storage area. IL is a gravel pit/ rock quarry. Same page the <br />excavation varies from 0 feet to 23 fef:t. How deep have you excavated <br />now? Carl Mount from the Division of Minerals and Geology was out here <br />inspecting Lhe mine site and the spring and thinks that with the lay of <br />the land all water from the whole area :is directed underground down the <br />draw where the spring is, and if they mine deep enough they could <br />
