<br /> <br />The map labeled 'MLRD Exhibits D & E' indicates that mining <br />will occur within approximately 50 feet of the County Road 61. <br />If this is indeed the case, C.R.S. 34-32-115 (4)(d) stipulates <br />that the mining operation will not adversely affect the <br />stability of any significant, valuable and permanent man-made <br />structures located within two hundred feet of the affected <br />land, except where there is an agreement between the operator <br />and the persons having interest in the structure that damage <br />to the structure (the road) is to be compensated for by the <br />operator.
