Long <br /> <br />Pueblo, CO 81003 Division Direcor <br />RE: M-1978-283 Sand Arroyo pit, Permit Adequacy. <br />Dear Mr. Gagliano, <br />The Division has reviewed your conversion application and has the following comments. <br />n EXHIBTI' "D" MINING PLAN 6.4.4 <br />A )Under (b), the operator sates, "the plant growth is limited to 12-18 inches. This minimum <br />amount will be salvaged and stockpiled on the north and south affected area boundary if required <br />by MLRB. This may be used to back slope the walls of the arroyo in final reclamation. However, <br />this will be some what of a futile effort since the stream flow will wash it out. <br />It si the requirements of the Construction Materials Rules and Regulation, for an operator to <br />properly salvage and protect all available growth medium that will be utilized to reclaim the site. <br />Since the permit area covers parcels that aze outside of the area that will be flooded, operator is <br />required to place these top soils in these areas. <br />B) Under (h), the operator states, "No water will be used in conjunction with this operation, <br />therefore no source is required ". <br />During the pre-operational inspection, a sizable pond along the West side of the permit azea was <br />noted. This same pond is identified on both the mining and reclamation map, as settling pond. <br />Please explain. If the water source is from ground water, the operator would need the appropriate <br />water right permits from the State Engineers Office. <br />II) EXHIBIT "E" RECLAMATION PLAN 6.4.5 <br />A) According to the information provided in the conversion application, it is the understanding <br />of the Division that the operator is committed to back slope all the embankments to a 3H:1 V or <br />gentler slope. <br />B) Under subsection (d), The operator states, "there will be no temporary or lazge siltation <br />structures in this operation". Please refer to question under EXHIBTT "D" (B). <br />
