REPORTING REQUIREMENTS (cont.) <br />"I certify under penalty of law that this document and all attachments were prepazed under my direction or <br />supervision in accordance with .r system designed to assure that qualified personnel properly gather and <br />evaluate the information submitted. Based on my inquiry of the person or persons who manage the <br />system, or those persons dtrecd:y responsible for gathering the information, the information submitted is, <br />to the best of my knowledge and belief, true, accurate, and wmplete. I am awaze that there are <br />significant penalties for submitting false information, including the possibility of fine and imprisonment for <br />knowing violations." <br />Retention of Records <br />The permittee shall retain a copy of the SWMP required by this permit for the duration of this permit. The <br />permittee shall_ retain copies of all report<.; required by this permit and records of all data used [o compete the <br />application to be certified under this pemrit, for a period of at leas[ three years. <br />4. Other Reoortine Procedures <br />Incidents such as spills or other dischazgrs shall be included in the records. Inspections and maintenance activities <br />shall be documented and recorded. This does no[ relieve the perttrittee of the responsibility of repotting spills as <br />required under section 25-8-601(2) of tht: Colorado Water Quality Control Act. <br />F. TERMINATION OF PERMIT COVERAGI's <br />Termination Criteria <br />a. Reclamation Pernik Release: When a site has been reclaimed in accordance with the Colorado Division of <br />Minerals and Geology ("CDMG") requirements and the. site haz been released from State reclamation <br />requirements, the permittce may request stormwa[er permit termination. <br />b. Termination in the absence of CDMG Permit: For facilities without CDMG permits, permittees wishing to <br />terminate stormwater permit coverage through mine-waste remediation must amrnd their SWMP [o include the <br />i[ems listed in Pan 1.C.5, above, prior to implementazion of the remediation work. In addition, permittees <br />seeking coverage under the Voluntary Cleanup Act must notify the Division of their intent 30 days before any <br />remediation activities commence. The notification must include certification language and signature by the <br />permittee. (See Pan I.E.2 of the pt:rmit.) <br />Certification under this permit may be terminated once raw materials, intermediaze products, byproducts, <br />finished products and waste products (including acid generating material exposed by the [Wining activity) have <br />been removed or isolated and the site has been stabilized (with little evidence of soil erosion or other runoff <br />problem) and revegetated. The following criteria must be met for the entire mine site, including any on-site <br />disposal azeas: <br />1) all raw materials, intermediatt: products, byproducts, finished products and waste products (including acid <br />generating material exposed by the mining activity) have been removed or permanently isolated from <br />stormwater; and <br />2) all soil disturbing activities at the site have been completed; and <br />3) vegetation has been established with an average cover or density, over the previously disturbed area, of a <br />minimum of 40 percent vegetaive cover or 70 percent of the vegetative cover of a similaz undisturbed <br />site, whichever is higher (vegetative cover or density determinations need not be determined scientifically <br />by extensive measurement an<i statistical analyses; simple representazive transects are adequate.); or <br />equivalent pe**+~~~r+t physical erosion reduction methods have been employed. <br />The Division tray, after consultation with the permit[ee and upon good cause being shown, revise the vegetative <br />cover requirement on a case-by~ase basis. <br />
