BASIC TERMS AND CONDTITON -ALL FACII.11'IES (cont.) <br />measures identified in the SWD~1P shall be observed to ensure that they aze operating correctly. <br />2) Based on the results of the inspection, the description of the po[ential pollutant sources and the pollu[ion <br />prevention and control measutt;s that are idrntified in the SWMP shall be revised as appropriate as soon as <br />practicable after such inspection. Revised control measura shall be implemen[ed a timely manner, but in <br />no case more than 90 calendaz days afer the inspection, unless otherwise provided by the Division. <br />3) The operator shall keep a record of inspections, including the daze of the inspection, major observations <br />relazing to the implementation of the SWMP, and anions taken in accordance with pazagraph 2), above. <br />This record shall be made available to the Division upon request and snm a>;~Pn in the Annual or <br />Compliance Report. <br />6. Monitorine <br />Sampling and testing of stormwazer for :>pecific pazameters is not required on a routine basis under this permit. The <br />Division raerves the right to require saznpling and testing, on a case-byrase basis, in the event that there is reason <br />[o suspect that compliance with the SWMP is a problem, or to treasure the effectiveness of the BMPs in removing <br />pollutants from the dischazge. <br />SWMP Availability <br />Upon request, the permittce shall submit a copy of the SWMP to the Division, the Colorado Division of Minerals <br />and Geology and EPA, and any local a@;ency approving sediment and erosion plans or stormwater management <br />plans, within the time frames specified in the request. <br />All SWMPs required under this permit are considered reports that shall be available to the public under Section <br />308(b) of the CWA. The owner or operator of a facility with stormwaur dischazges wvered by this permit shall <br />make plans available to members of the public upon request, unless the SWMP has been submitted to the Division. <br />However, the permit[ce may claim any portion of a SWMP as confidential in accordance with 40 CFR part 2. <br />E. REPORTING REQUIREMENTS <br />1. Reporting <br />a. Amual Report for Active Mlning Operations, The permittce will be required to submit an Annual Report, <br />covering January 1 through December 31 of each yeaz, on the compliance with the SWMP. The Annual Report <br />will contain, az a minimum: <br />1) Name of permittce, address, phone number, and permit certification number. <br />2) A report on the facility's overall compliance with the SWMP. <br />3) A summary of each comprehensive stormwater facility inspection made, including date, findings, and <br />action taken. <br />4) Results and interpretation of any stormwater monitoring performed. <br />5) Certification language and si~yature by the permittce. (See Part I.E.2 of the permit.) <br />The Annttal Report will be due to the Division on or before February 15 of each yeaz. The exact due date for <br />the permittce's first Annual Report: will be listed in their permit certification. The Division reserves the right to <br />require additional information in dre report, on a case-by-case basis, as needed. <br />b. Compliance Report for Inactive Mining Operations: The permittce will be required to submit a repon on the <br />compliance with the SWMP. The report shall contain, az a minimum: <br />1) Name of permittce, address, phone number, and permit certification number. <br />2) A report on the facility's ovt:rall compliance with the SWMP. <br />
