I renew my suggestion for increasing the diversity of the proposed <br />grass mixture for reclamation and increasing long-term soil fertility by <br />\~/\ the addition of Sand dropseed and mellow sweetclover to the seed mix. Otero <br />County should commit to such a recommendation (or an equivalent recommendation <br />from the Soil Conservation Service) before this application goes to our Board. <br />Exhibit G: Water <br />2. When I receive comments from the Colorado Division of Water Resources <br />~ concerning this application, I will pass them on to you. <br />Exhibit N: Wildlife <br />1. I will anticipate receiving the evaluation from the Division of <br />Wildlife as soon as it is available. I will need it before the January 27-28 <br />j Board meeting. <br />Exhibit I: Soils <br />1. Z need a statement from the Soil Conservation Service concerning <br />the appropriateness of the topsoil that is proposed for importation and use <br />in reclamation before I can totally evaluate their revegetation recommendations. <br />Please request that such a statement be provided to our Division. Please <br />reference my comments concerning this matter in my letter of December 2nd. <br />Exhibit L: Reclamation Costs <br />As I mentioned in my letter of December 2nd, since counties do not post <br />a reclamation bond, the actual costs of reclamation to Otero County are not <br />really vital to this permit. Thus, my comments in this regard were largely <br />~ informational. However, the new resolution by the Otero County Commissioners <br />(incorporating wording from Section 39-32-117(1)(e) of the Mined Land Reclama- <br />tion Act) is needed before I can recommend approval of this application to <br />the Board. This resolution will commit Otero County to the reclamation, <br />regardless of cost. I have enclosed a copy of the relevant page from the <br />Act with appropriate wording to be incorporated in a resolution underlined. <br />I feel that we can iron out the last of our problems concerning this permit <br />before the January 27-28, 1982 Board meeting (to be held in our building, in <br />Room 110). If so, I am sure that this matter can be presented to our Board <br />in written form, and you will not need to be present. <br />Please call me if I can clarify any parts of this letter. <br />Sincerely, <br />Mark S.
