Therefore, the Division requests that the applicant provide a study based on current, site specific- <br />data, or support the findings in the W WE document with current, site-specific data. Additionally, due to the uncertainty <br />of the accuracy of the fmdings in this report under current conditions, the Division cannot accept the proposed trigger <br />point, which would require assessment and possible mitigation, of a drop of 5 feet in groundwater level below seasonal <br />fluctuation as proposed by the Applicant, and will require a commitment to a trigger point once the current conditions are <br />assessed for potential groundwater impacts at the site. <br />The Applicant has indicated that if groundwater is impacted in the vicinity of the site, "the Applicant would cease <br />dewatering operations until such time that a cause of the drop could be determined. If the cause is determined to be the <br />Applicant's mining operation, mitgafion efforts will be discussed at that time and decisions made will be based on which <br />mitigation measure best serves all parties involved. Some mitigation measure that could be employed would be re- <br />drilling wells, diverting available water supplies to the injured party, and/or tracking water to the injures party." The <br />Division requires a specific mitigation plan to be in place prior to approval of the pemrit application. Additionally, the <br />mitigation plan should specify what mitigation measures will be incorporated during the time that the cause of the change <br />in groundwater level depth is being investigated; what mitigation measures will be taken if the cause of the groundwater <br />level drop cannot be determined or identified solely as effects of the mining activity; and how the cause of the <br />groundwater level drop will be identified. Please submit a mitigation plan addressing the above-listed issues. <br />The Applicant proposes to install monitoring wells azound the site and to incorporate agroundwater-monitoring plan to <br />assess any potential impacts on the groundwater by the mining activity. Please indicate the specifics regazding the <br />groundwater monitoring plan including, the number and location of monitoring wells and the number and location of <br />private wells to be incorporated in the plan, the frequency of measurement, and the reporting pazameters regazding the <br />groundwater data. <br />The Applicant has committed to 5 quarters of groundwater monitoring prior to dewatering the site in order to establish a <br />baseline groundwater level. In that the concern of effects on groundwater ate related to the slurry wall, however, the 5 <br />quarters of monitoring data will need to be collected prior to installation of the slurry wall. Please commit to this <br />pazameter. <br />Rule 6.4.8 Exhibit H-Wildlife Information <br />19. Section (1) (c} requires the ApplicanUOperator to included the presence and estimated population of threatened or <br />endangered species from either federal or state lists. As mentioned in the previous adequacy review letter, it is necessary <br />for the Division to receive a letter from the U.S. Fish and Wildlife Service indicating that the mining plan has cleazance <br />through them prior to approval of the permit. Please supply this information. <br />Rule 6.4.12 Exhibit L -Reclamation Costs <br />The following item appeazed in the original adequacy review letter: <br />22. The Division will estimate the cost to reclaim the site once the applicant addresses the concerns noted in tlis letter. <br />The Division will estimate a cost to reclaim the site based on the information submitted in the application and responses <br />to tlis adequacy review, however, the Division also needs the following information: <br />• Please list all structures that will be conshucted on site including their composite, dimensions and method of <br />reclamation. <br />The adequacy review response from the Applicant indicated that no structures will be constructed on the site as part of <br />reclamation. For clarification, the Division requests this information with regard to structures that will be constructed on <br />the site during mining, so that the demolition of said structures can be calculated into the reclamation costs. Please <br />supply the requested information. <br />Rule 6.5 Geotechnical Stability Exhibit <br />25. The Geotecluical stability exhibit submitted with the permit application is still in the process of being reviewed <br />sepazately by Allen Sorenson within the Division of Minerals and Geology, and any adequacy review comments related <br />to tlils exhibit will be addressed in a sepazate letter at a later time. <br />
