Cottony <br /> Division DIrCClOr <br /> Natursl Resource Trustee <br />RE: SW Meadow, LLC, File No. M-2003-016 <br />Heit Sand and Gravel 112c Permit Application- Second Adequacy Review <br />Deaz Mr. Gesso, <br />Listed below aze the second adequacy review comments for the Heit Sand and Gravel 112(c) Permit Application, File No. M- <br />2003-016. The Division of Minerals and Geology ("Division") is required to make a recommendation no later than August 4, <br />2003, therefore, your response to the following adequacy review concerns should be submitted to the Division as soon as <br />possible. <br />Rule 6.4.4 Exhibit D- Minine Plan <br />The initial adequacy review requested that the Applicant describe how the facilities will be managed to ensure <br />groundwater and surface water will not be impacted and to describe the nature and storage location for all hazardous <br />waste that will be used on site. The applicant responded that diesel fuel and ACID will be stored in double-walled, <br />above-ground storage tanks, and that lubricants, coolants and motor oil will be stored in 55-gallon, double-walled drums. <br />The applicant further states that since all above-ground containers aze double-walled, secondary containment measures <br />such as beraLS aze not necessary. Please submit measures that will be taken in order to contain spills related to damaged <br />fittings on the tanks or which occur while filling these tanks and barrels. Additionally, all newly issued awning permits <br />contain the following stipulation: <br />A reportable spill is a spill of any toxic or hazaddous substance (including spills of petroleum products) within <br />the mined land permit area reportable to any Division of the Colorado Department of Public Health and the <br />Environment, the National Response Center, the Colorado Emergency Plannntg Commission, any local <br />Emergency Planning Commission, local Emergency Planning Committee, or the State Oil Inspector. The Mine <br />Operator shall notify the Division of Minerals and Geology (DMG) of a reportable spill within the mined land <br />permit azea using the same timeframe required by the permit, license, notice, statute, rule or regulation <br />governing the reporting of the spill to the other appropriate agency. Notice of a reportable spill shall be FAXed <br />to: Minerals Program Supervisor, Division of Minerals and Geology, FAX (303) 832-8106. The FAX shall <br />include atoll-back number of a responsible company official for DMG staff to use a contact. <br />Please commit to the pazameters of this stipulation. <br />Rule 6.4.7 Exhibit G -Water Information <br />14. The initial adequacy review requested that the Applicant identify and characterize the aquifer to be mined in or through. <br />The Applicant has submitted a groundwater evaluation report by Wright Water Engineers (WWE) for the azea including <br />the proposed mining operation. Although the WWE report does address the predicted affects that a slurry wall will have <br />on the groundwater is the azea of the site, the report is based on historical data (1972) and on general information for the <br />valley-fill aquifer in the Brighton Reach of the South Platte River Valley. The study is not based on current data that is <br />site- specific.
