~i EXHIBIT D Phase 3 mining will occur on the south half of the outlined mining area (see Exhibit C) on Flatirons Property. This last phase will be mined north to south, after a dewatering trench has bean excavated along the perimeter. This water will be pumped into the adjacent pond, or the Big Thompson River as needed. An NPDES permit will be acquired and a sedimentation basin constructed as needed to preserve water quality standards. Sediment trapped in such a basin will be removed periodically and used for reclaim. Stockpiles for Phase 3 will be located in the pit excavated during Phase 2. The concrete batch plant currently on-site will be removed prior to the start of Phase 3. Public sale will continue at the site, and an asphalt batch plant may be located within the permit area to the west of the actual pit (see Exhibit C). Few improvements will be necessary to provide truck access to the west end of the Flatiron property. Upon completion of Phase 3, after 3-4 years of mining, reclamation of Phases 2 and 3 will commence and be completed within 1-2 years of cessation of mining activities. This material will be stockpiled for reclaim and seeded with fast-growing mix to avoid soil erosion if the piles will not be moved for more than one growing season. The same equipment will extract and transport sand and gravel resource. During Phase I, the resource will be hauled across St. Louis Avenue onto the northeast corner of the Flatiron property. During Phases 2 and 3, resource will be mined, processed and stockpiled on-site.
