PART II <br />Page No. 16 <br />Permit No. COG-850000 <br />NOTIFICATION REQUIIIEMENTS <br />3. Special Notifications -Definitions <br />a. Bypass: The intentional diversion of waste streams from any portion of a treatment facility. <br />b. Severe Property Damage: Substantial physical damage to property az the treatment facilities which causes them to <br />become inoperable, or substantial and permanent loss of nanrral resources which can reasonably be expected to <br />occur is the absence of a bypass. It does not mtean economic loss mused by delays in production. <br />c. Spill: An incident in which flows or solid materials aze accidentally or unin[entionally allowed to flow or escape so <br />as to be last from the veazmemt, processing or manufacturing system which may cause or threaten pollution of stale <br />wazers. <br />d. Upset: An exceptional imcidrnt in which there is unintentional and temporary noncompliance with permit effluent <br />limitations because of factors beyond the reasonable control of the permittee. An upset does apt include <br />noncompliance m the extrnt caused by operazional error, improperly designed vestment facilities, inadequaze <br />vestment facilities, lack of preventative maintenance, or careless or improper operation. <br />4. Noncompliance NotiPcatioa <br />a. If, for any reason, the permittee does not comply with or will be unable to comply with any dischazge limitations or <br />standards specified in this permit, the permittee shall, az a minimum, provide the Division wad EPA with the <br />following information: <br />i. A description of the dischazge and cause of noncompliance; <br />ii. The period of noncompliance, including enact dates and times and/or the anticipated time when the discharge <br />will renrrn to compliance; wad <br />iii. Steps being taken to reduce, eliminate, and prevent recurrrnce of the noncomplying discharge. <br />b. The permittee shall repon dte following circumstances verbally within tweMV four hours from the time the <br />petmittx becomes aware of the circumsances, and shall mail to the Division a writtrn report wataining [he <br />information requested is Part II.A.4.a. within five davs after becoming aware of the following cire!~~+M~~Ces: <br />Circumstances leading to any noncompliance which tray endanger health or the environment regazdless of the <br />cause of the incident: <br />ii. Circumstances leading ro any unanticipazed bypass which exceeds any effluent limitations im the permit; <br />iii. Circumstances leading to any upset or spill which causes an exceedance of any effluent limitation in the permit; <br />iv. Daily ~*+~zitm~m violazions for any of the pollutants limited by Part [.B.1. of this permit and specified as <br />requiring 24 hour notification. This includes any toxic pollutant or hazardous substance or any pollutant <br />specifically identified as the me[hod to control any toxic pollutant or hazardous substance. <br />c. The permitter shall report instances of non-compliance which are not requited to be reported within 24-bouts at the <br />time Discharge Monitoring Reports aze submitted. The reports shall contain the information listed in sub-paragraph <br />(a) of this section. <br />
