General Limitations -Active and Post-Minine Outfalls <br />1) There shall be no discharge of sanitary wastcwazers from toilets or related facilities. <br />2) There shall be no dischazge of floating solids or visible foam is other than trace amounts. <br />3) There shall be no land application of wastewater other than for dust watrol. <br />4) No chemicals shall be added to the discharge unless specific approval is granted by the Division <br />d. Burden of Proof Reauiremenrs <br />The petmittee has the btrrdrn of proof when ttxluesting relief from [oral suspended solids (CSS), total iron <br />and/or sealeable solids limitations. Relief shall be granted only when necessary and shall not be granted <br />whrn the petmittee has comrol over the dischazge. The petmittee should endeavor to [nett the primary <br />limitations whenever possible. The Division shall have final authoriry in det~rmtning whether relief is <br />granted. <br />1) For rainfall ro waive TSS and total iron limitations, it is necessary to demoastra[e that disrharge <br />occurred within 48 bouts after ttteativrable precipitation has stopped. io waive seNeable solids <br />limitations, it is necessary to prove thaz discharge occurred within 48 hours after precipitation greater <br />than the 10-year, 24-hour evem has stopped. <br />2) For mowmelt, to waive TSS and mtal iron limitations, it is necessary to demonstra[e that discharge <br />occurred within 48 hoots afer pond inflow has stopped. To waive settleable solids limitations, it is <br />aecessazy to prove that dischazge occurred within 48 hours after pond inflow volume greater than the <br />10-yeaz, 24-hour event has stopped. <br />The Division shall determine the adequacy of proof. As part of this duettrtiaation, the Division shall <br />evaluate whether the perrttittee could have controlled the discharge is mc6 a +++~*+++'* that primary limitations <br />could have bern rnet. All manual dewazeting of ponds that are equipped with automatic dewatering systemr <br />must meet TSS and total iron limitations. If a pond has only trtanual dewatering capability, relief is <br />available only to the extent required to regain naessary stability and capacity. <br />See Part I.C. Cor Deflaitioos <br />
