The Division has suggested these areas <br />need attention due to coal deposits caused by the June 7, 1984 <br />flood which cut across Blue Ribbon's lower coal stockpile. I note <br />that a copy of your August 13, 1984 letter relating to this subject <br />did go to the Montrose office of the Bureau of Land Management. <br />The Bureau of Land Management has inspected the site since BLM <br />surface was, potentially, affected. As we have now thoroughly <br />analyzed Areas A, B, and C as defined by the map attached to your <br />letter, we find that all three of those areas are north of the <br />property boundary which separates U. S. Steel Corporation surface <br />from Bureau of Land Management surface. Therefore, prior to per- <br />forming equipment clean-up on those areas, Blue Ribbon will seek <br />written permission from U. S. Steel Corporation, the land owner of <br />that area. Since no machine clean-up will be required for BLM surface, <br />Blue Ribbon will not seek approval for right of access from them. <br />The Bureau of Land Management gave us verbal permission to enter <br />their property for the purposes of hand clean-up, effective August 13, <br />1984. <br />Blue Ribbon has prepared a map attachment for this submission <br />which illustrates the coal deposits you designated A, B, and C; the <br />map also illustrates surface ownership and the proposed stream buffer <br />zone which will be established to protect the creek during the recla- <br />mation process. Area D, as defined in your letter, is south of this <br />map attachment, and we accept your description as the definition for <br />the area, i.e. "the stream channel one mile downstream near the <br />Deer Trail ditch intake". Blue Ribbon's intent towards Hubbard Creek <br />reclamation will be limited only to solving the Division's concerns <br />within these four areas, A-D. Note that machine clean-up will be <br />required in Area A and a portion of Area C. No machine clean-up will <br />occur on the remainder of Area C, or Areas B and D. The area designated <br />on the map as C' is the portion of your Area C that will require equip- <br />ment clean-up. <br />
