,., <br />is <br />SPECIAL CONDITIONS <br />A. That 36.15 acres of wetlands will be mitigated on site within the identified wetland mitigation azeas as <br />depicted in drawings 8 and 9 "Mitigation sites". <br />B. That a weed control plan will be designed and implemented no later than Mazch 31, 2002, and <br />maintained throughout the existence of this permit. <br />C. If bank stabilization for any of the streams, rivers, and drainages within the boundaries of the project <br />becomes an issue with the Corps; the Camas Colorado,lnc. will ensure that corrective action will be taken <br />immediately. The corrective action will be coordinated with the Corps of Engineers Regulatory Branch <br />prior to commencing work unless emergency action is a necessity. The preferred use for this action is one <br />that the Corps would consider environmentally sensitive. <br />D. That a conservation easement will be placed on the wetland mitigation sites for this project. ~` ~-cos ~a~u <br />E. That wetland mitigation will be performed in conjunction with the mining disturbance. If for some <br />reason wetland mitigation falls behind the mining aggressive steps, must be taken to bring it up to an <br />acceptable level within the next year. This is to ensure that the functions and values of the wetlands are not <br />totally lost and the aquatic resource is not required to be without those functions and values for an extended <br />period of time. <br />• F. That if any cottonwood trees are lost (die) due to the mining operation CAMAS will replace the <br />dead/dieing trees by planting 5 seed producing Cottonwood trees for each dead tree. These trees will be a <br />minimum of 2 inches in diameter. The mitigated trees will be required to maintain a survival rate of 4 out 5 <br />trees. That is, if 10 trees were planted due to this special condition eight of the planted trees must be in <br />goad health before the Corps will consider the planting of trees acceptable. These mitigated trees must <br />thrive for a minimum of three consecutive years after the mining is completed to be considered acceptable. <br />This is not to say that CAMAS is permitted to ignore the planting of such Bees until they near the end of the <br />mining operation. Planting of trees will take place at such time the appropriate tree planting azea is <br />available. Availability is determined by the Corps. <br />G. Live stock grazing will not be allowed within 50 feet of any wetland mitigation site. <br />H. That a detailed wetland mitigation plan will be submitted to the Denver Regulatory Office for review <br />and acceptance no later than June 30, 2000. The mitigation plan will incorporate wet meadow complexes <br />with open water. This design will have mostly wet meadow wetland with 3-4 irregulazly shaped open water <br />areas and some shallow (1-2 feet deep) standing water areas. <br />I. That the relocated seep/stream will be constructed to be similaz in nature to the existing stream - <br />relatively uncottfined channel with a wide area for plant growth on each side of the stream From a habitat <br />stand point the vegetation will be replaced in kind as that pre-existing to mining. <br />J. That annual wetland monitoring reports will be performed by the applicant each yeaz beginning in the <br />year 2002.. These reports will be submitted to the Denver Regulatory Office on or before December 1, of <br />each year until the Corps determines the mitigation viable and self-sustaining. These reports will include but <br />not be limited to the following i.-tformation <br />8. <br />
