1 ~' <br />7. That all construction debris will be disposed of on lan~in such a manner that it cannot enter a waterway <br />or wetland. <br />8. That equipment for handling and conveying materials during construction shall be operated to prevent <br />dumping or spilling the materials into the water except as approved herein. <br />9. That measures will be employed to prevent or control spilled petroleum products, chemicals, or other <br />deleterious tnaterials from entering the water and the peimittee will formulate a contingency plan to be <br />effective in the event of a spill. <br />10. That all work in the waterway is performed in such a manner so as to minimize increases in suspended <br />solids and turbidity which may degrade water quality and damage aquatic life outside the immediate azea of <br />operation. <br />11. That fuel storage tanks above ground shall be diked or curbed or other suitable means provided to <br />prevent the spread of liquids in case of leakage in the tanks or piping. <br />12. That the clearing of vegetation will be limited to that which is absolutely necessary for <br />mnstructian of the project <br />13. That when the District Engineer has been notified that a filling activity is adversely affecting fish or <br />wildlife resources or the harvest thereof and the.District Engineer subsequently directs remedial measures, <br />the permittee will comply with such directions as may be received to suspend or modify the activity to the <br />extent necessary to mitigate or eliminate the adverse effect as required. <br />14. That all dredged or excavated materials, with the exception of that authorized herein, will be placed on • <br />an upland site above the ordinary high water line in a confined azea, not classified as a wetland, to prevent <br />the return of such materials to the waterway. <br />15. That all earthwork operations on shore/bank will be carried out in such a manner that sediment runoff <br />and soil erosion to the water and wetlands aze prevented. <br />16. That all areas along the bank disturbed or newly created by the construction activity will be seeded with <br />vegetation indigenous to the area for protection against subsequent erosion. <br />17. That the.cross-sectional area of the channel is not reduced to less than existing prior to, during, <br />and after any construction activity. <br />18. That the fill created by the dischazge will be properly maintained to prevent erosion and other non-point <br />source of pollution. <br />19. That close coordination will be maintained by the contractor with downstream water users, advising <br />them of any water quality changes to be caused by the construction. <br />20. That the disposal area, method of disposal, or methods of dredging will not be changed without prior <br />written approval of the District Engineer. <br />21. That the discharge will consist of suitable material free from tonic Pollutants. <br />7. <br />
