The applicant shall obtain a new Air Pollution Emissions <br />Permit, if necessary, and provide copies to the Planning <br />Department within ninety (90) days of Board of County <br />Commissioners' approval. <br />4. ~Nater and wastewater facilities (which may consist of bottled <br />water and Aorta-potties) shall be made directly available to <br />employees at the various work sites. <br />5. Mining activities will be limited to the 52.30-acre legally <br />defined area in the northern parcel along with those <br />portions of the southern parcel delineated in the graphic <br />provided by the applicant and included in the file as <br />further defined in the attached description. Specific <br />excluded areas at this time include those where the Bureau <br />of Land Management retains rights to the mineral estate, <br />any areas which are clearly in view from Interstate 25 and <br />any property currently within the 700-year regulatory <br />floodplain. <br />6. Trucks leaving the mining area will be covered in the event <br />that aggregate diameter is such that material could be or is <br />blown or falls from the haul trucks. In all cases, the out- <br />side rails of trucks will be swept prior to exiting site. <br />Notice of these regulations will be prominently displayed. <br />7. In the event this facility is required to utilize EI Centro <br />Boulevard for access upon the closing of its existing <br />temporary access to Interstate 25, the owner/operator will <br />be required to participate on a pro rata basis in the cost of <br />constructing EI Centro Boulevard to Interstate 25. The <br />owner/operator shall also participate in the maintenance of <br />said road if it is not maintained by EI Paso County. This <br />maintenance shall also include any dust control mitigation <br />measures as required by EI Paso County. <br />NOTATIONS: <br />1. No mining or removal of material from the area contained in <br />the Bureau of Land Management mineral reservation areas <br />can take place without first receiving the approval of the <br />Bureau of Land Management. <br />2. As noted by the Colorado Department of Highways, should <br />traffic volumes increase sufficiently to cause congestion at <br />the interchange, the operators of the gravel pit will be <br />responsible for any improvements required. <br />
