4. Certain surface installations within the <br />permit area are to be located on lands pur- <br />chased by Sheridan Enterprises, Inc. from <br />Ival S Ed Young, Inc. These lands were <br />conveyed by a deed executed on March 5, <br />1980, a copy of which is attached hereto <br />as Exhibit VI. <br />5. Sheridan Enterprises, Inc. is proposing <br />to connect these fee lands with the leased <br />lands noted above by a right of way for <br />a haul road across a parcel of intervening <br />Federally-owned land. An application for <br />this right of way, No. C-30962, was filed <br />with the Bureau of Land Management on <br />• October 27, 1980. A copy of said applica- <br />tion is attached hereto as Exhibit VII. <br />6. Aaportion of the permit area is a rail <br />loadout site in Loma, Colorado. The right <br />to enter this parcel is embodied in a <br />lease between The Denver and Rio Grande <br />Western Railroad Company and Sheridan <br />Enterprises, Inc., dated June 1, 1978, <br />a copy of which is attached hereto as <br />Exhibit VIII. <br />The right of Sheridan Enterprises, Inc. to enter and begin <br />surface coal mining operations in the permit area is not the <br />• subject of any pending litigation. <br />
