The righ t of Sheridan Enterprises, Inc. to enter and begin
surface coal mining operations in the permit area is based
upon the following documents:
1. Two Federal Coal Leases, No. C-0125515 and
No. C-0125516, between the United States and
Industrial Resources, Inc. were executed
April 12, 1968, with effective dates of
May 1, 1968. Copies of both leases are
attached hereto as Exhibits I and II,
respectively. Under said leases, the lessee
has the right to enter upon the surface of
the lands leased and to mine the coal con-
• tained therein. Both the surface estate
and the coal in the lands covered by the
leases are owned by the United States.
2. On December 9, 1976 the Bureau of Land
Management rendered its decision recog-
nizing that industrial Resources, Inc. had
changed its name to Industrial Assets, inc.
A copy of this decision is attached hereto
as Exhibit III.
3. Said leases were assigned to Sheridan Enter-
prises, inc. by two assignments executed
December 22, 1977, copies of which are attach-
ed hereto as Exhibits IV and V.
