EXHIBIT C-VII <br />SHERIDAN ENTERPRISES, INC. <br />9745 East Hampden Avenue <br />No. 3 50 <br />~enver, Colorado 80231 <br />03) 751-0093 <br />October 22, 1980 <br />United States Department of Interior <br />Bureau of Land Management <br />State Office <br />Room 700 <br />1600 Broadway <br />Denver, Colorado 80202 <br />Re: APPLICATION FOR RIGHT-OF-WAY, <br />GARFIELD COUNTY, COLORADO. <br />Dear Sir: <br />Sheridan Enterprises, Inc. is in the process of developing <br />issued federal coal leases in Garfield County, Colorado. <br />Immediate plans call for the development of an underground <br />coal mine on Federal Coal Leases C-0125515 and C-0125516. <br />• At present Sheridan Enterprises, Inc. is accessing the leases <br />via an existing road that connects fee land controlled by <br />Sheridan Enterprises and Federal Coal Lease C-0125515. This <br />existing access road crosses federal land in Section 29, <br />TSS, R102W, the use of which is authorized by Temporary Use <br />Permit No. CO-076-TU-80-3, issued November 6, 1979. The <br />purpose identified for this Temporary Use Permit is for access <br />to and coal haulage from the issued federal coal leases <br />via the previously established road. <br />Sherdian Enterprises now makes application for right-of-way <br />across this federal land pursuant to 43 CFR 2800 which <br />implements the Federal Land Policy and Management Act of <br />October 21, 1976 providing the authority for granting of <br />rights-of-way by the BLM. If approved, Sheridan Enterprises, <br />Inc., agrees that the right-of-way will be managed in <br />accordance with and subject to the terms and conditions of <br />the applicable regulations in 43 CFR 2800. <br />NECESSITY FOR RIGHT-OF-WAY <br />The granting of this right-of-way will allow for continued <br />access and development of issued Federal Coal Leases C-0125515 <br /> <br />
