All gravel stock- <br />piled shall be piled within the pit. <br />d. Lessee shall not permit, use. or allow to be used any remainder of the <br />leased premises for any activity unrelated to its gravel operations as provided <br />herein. <br />e. Lessor shall not have the right to sell gravel to other parties during <br />the term of this lease. nor shall the Lessor have the right to set up and <br />operate his own equipment for the purpose of quarrying, mining, removing and <br />marketing during the term of this lease. <br />f. A gate with padlock shall be provided at the entrance to Highway <br />U.S. 40 by Lessee with a key for Lessee and one for Lessor. The gate shall <br />remain locked when Lessee is not utilizing the site. <br />g. There 1s an existing pile of crushed gravel that was stock piled by <br />the County and it is estimated to be at 5,000 to 10.000 yards (to be determined <br />when stockpile is moved), that will be sold at the prior contract price of .40 <br />per cubic yard. <br />5. PROTECTION AND RESTORATION OF SLRFACEe Lessee agrees that on termina- <br />tion of this lease to replace all materials not used and back slope or grade <br />such area. The Lessee shall be responsible for reclaiming the entire pit to <br />Lessor's satisfaction. <br />Reclamation shall consist of the Lessee's replacing stored soil over mined <br />and sloping banks to no less than 4 to 12 or 18.4 degrees, as well as furnishing <br />seed to Lessor for planting. Lessee agrees to keep the existing and expanded <br />pit and top soil stockpiles free from weeds during the lease and for two (2) <br />years following expiration of lease to enable Lessor to plant seed. Any <br />mixture of Tordon will not be used. County's reclamation obligation shall 6e <br />as stated herein unless MLRB establishes more stringent or additional require- <br />ments. <br />6. TND MNIFT.AT70N OF SSORe Lessee agrees to indemnify Lessor against <br />all liability for inJuries to persons or property caused by the Lessee's <br />negligent use or occupancy of the premises during the term thereof. <br />7, it Nc AND NOTT~ c, The Lessee agrees to save and keep harmless the <br />Lessor and said premises and every part thereof from liability and claim or <br />lien for work done, services rendered or material furnished in respect to said <br />premises and every part thereof; and to forthwith post and at all times to keep <br />
