.~ <br />.',' <br />THIS LEASE made and entered Into this 1st day of March. 1985, by and <br />between H.W. Hooker and Avis H. Funk, hereinafter called "Lessor", and the <br />COUNTY OF ROUTT, STATE OF COLORADO, hereinafter called the "Lessee". <br />The parties hereto, for the consideration hereinafter mentioned. covenant <br />and agree as follows: <br />1. PREMr_sES~ Lessor leases to Lessee that certain tract of land owned by <br />the Lessor situate in Routt County. State of Colorado, which is described, per <br />Mined Land Reclamation application. as a portion of the N L2 of Section 12, <br />Township 6 North, Range 88 West of the 6th P. M., for the purpose of quarrying, <br />mining, and removing therefrom all gravel, which shad be referred to as <br />"gravel". The tract of land includes and 1s adfacent t0 the existing gravel <br />pit only. Expansion shall be 1n a southeasterly direction at the same elevation <br />as the existing pit. <br />Z. TERM OF LEAC_E: This lease shall be in effect for a period of three <br />(3) years from the day and year first written above. <br />3. ROYALTSESe Lessee shall pay to Lessor, as royalty. forty cents (.40) <br />for each ton removed from the site. The quantity of pit-run gravel which is <br />removed from the premises shall be measured by random samplings of each truck <br />twice daily. <br />All royalty payments under this lease shall be made by Lessee to Lessor on <br />or before the tenth (10th) day of each and every month during the term of this <br />lease for all gravel removed by the Lessee during the proceeding month. <br />Payments shall be made to H.W. Hooker and Avis H. Funk at PO Box 28. Hayden. <br />Colorado 81639. A71 gravel paid for by the Lessee shall be removed by the <br />Lessee within one (1) year after the termination of this lease. <br />4. RT,1•ITS AND OBLT,ATTONC OF LFSS <br />a. Lessee shall have the right to erect a hotbatch plant or crusher on <br />the premises to process the gravel thereon. <br />b. Lessee shall have a non-exclusive right of ingress and egress over the <br />leased premises to carry out the obJectives of this lease. Access to the <br />grave] pit will be limited to County authorized personnel. <br />c. All gravel removed from the pit will be by County personnel. Gravel <br />
