Ms. Casey indicated that this would be <br />referred to Mr. Mick Schmitt for resolution. <br />Mr. Shukle, at this point Sun Coal Company has been accused of violating this permit <br />repeatedly, when the permit was properly modified prior to the time the violations were <br />alleged to have occurred. There never was a violation of the permit. Secondly, there is a <br />serious problem in your section when this accusation of violation occurs not once, but twice, <br />even with an intervening logical response to your staffs concerns. Lastly, WQCD has <br />accused Sun Coal of a violation, and forwarded that accusation to the local health department, <br />the WQCD field support section, and an undetermined "MS-3" file. <br />Savage and Savage is requesting that WQCD acknowledge that Sun Coal Company was not <br />and is not in violation of permit number COG-850012 with respect to monitoring of discharge <br />point 001, and that any correspondence referring to delinquent discharge reporting after May <br />30, 1996 was in error. We request this acknowledgment in writing and that this <br />acknowledgment be sent to Sun Coal, ourselves, CDMG, the local health department that <br />received that delinquency notices, and to the WQCD, Field Support Section. <br />We look forward to your response and to the swift and final resolution of this problem. <br />Sincerel , <br />-... <br />Michael S.
