Box 3059 <br />Grand Junction, CO 81502 <br />Re: Request for Formal Comments Regarding the Proposed Tellier Gravel Pit. <br />Dear Mr. Gierhart: <br />This letter is being written to formally request comments from the Public Service Company <br />of Colorado regarding a proposed gravel pit mine which is being reviewed by the Routt <br />County Board of Commissioners. The object of this letter is two fold. Firstly, during a <br />recent meeting of the Routt County Planning Department, we were given conditional <br />approval for this project provided we obtained a response in writing acknowledging your <br />review and approval of the proposed haul road crossings of the existing natural gas pipe <br />line and that mining of gravel outside of your legal right of way would not impair the <br />structural integrity of the pipe line. <br />The second reason we are writing is to satisfy the permitting requirements of the <br />Colorado Division of Minerals and Geology regulations which states that the owners of <br />all structures located with 200 feet of the affected mine area must be notified of the <br />proposed gravel mining operation. Similarly, we would request a determination whether <br />you believe that mining of lands up to and outside of the legal right of way will possibly <br />affect the structural integrity of the pipe line. <br />In order for you to complete your evaluation, I am enclosing three figures. The first, <br />shows the project site in relationship to the Yampa River Valley and U.S. Highway 40. The <br />project area is located approximately five miles west of Steamboat Springs, Routt County, <br />Colorado. This figure is entitled the "Tellier Gravel Pit -Site Location Map." The second <br />figure shows the proposed mine area, which is divided by your natural gas pipe line. This <br />figure is entitled "Tellier Gravel Pit -Proposed Mine Area Plan Map." You may recall that <br />I called you some time ago and asked for the legal description of the easement and you <br />gave me the name and number of your right of way specialist in Denver. This information <br />was obtained from him. Mining will occur on either side of your right of way but not within <br />it. The only encroachment inside of the right of way is for two haulroad crossings. One <br />along the east side of the property and a second just to the west of the drainage which <br />crosses the site. No excavation will occur on the road crossings, as you have suggested <br />in other gravel permitting actions. <br />The third figure shows a proposed cross section of the mining area in the vicinity of the <br />pipe line showing how deep the gravel deposit is which will be mined. This figure is called <br />the "Tellier Gravel Pit -Mining Area Profile." As shown on this cross section, mining will <br />result in approximately 20 feet of gravel being removed. As shown on this figure, we are <br />proposing to leave a minimum of a 3:1 slope on all portions of the property which will not <br />be mined. Thus your right of way will be protected by the fifty foot width as well as the <br />
