Sheldon, Director <br />Mined Land Reclamation Division <br />Colorado Department of Natural Resources <br />1313 Sherman Street Room 423 <br />Denver, Colorado 80203 <br />Dear Mr. Sheldon: <br />I am questioning the issuance of a coal lease by the Colorado <br />State Land Board which was won today by a Mr. James Healy, <br />because of his possible involvment, by his own admission, in <br />a coal mining operation located 4 miles southwest of Aguilar, <br />Colorado which has all appearances of being in default of <br />state coal mining regulations. <br />According to your Mr. Gregg Squire the Sunshine Mine is being <br />operated under a two acre disturbance plan which does not re- <br />quire a state permit. It once operated under permit number <br />76-14 which was terminated and reclaimed. <br />Mr. Healy told me on the phone he was involved in this operation <br />with his brother, but I have no proof of this statement. If it <br />is so he has no right to bid on state coal leases if the mine is <br />being operated in violation of regulations and he is part owner, <br />or whatever. Because my information is limited to a single <br />phone conversation to a man which admitted his involvment in <br />a probable illegal operation I wish my name to be held in confid- <br />ence. <br />All I ask of the Mined Land Reclamation Division is to look into <br />the matter and report their findings to Mr. Tom Bretz of the <br />Colorado Sta to Land Board. <br />I have not visited the Sunshine mine, but have driven by on the <br />road. From the attached segment of the Delagua Quadrangle cf <br />"Extent of Mining Map" given out by your department a measurement <br />of the road from the county road to the edge ~f the pit is at least <br />1600 feet. This would be part of the two acre parcel, and if the <br />road was only 20 feet wide it would amount to 0.7346'acres. A <br />few months ago another party and I were driving by the mine and saw <br />a paddle wheel scraper operating at the north end of the disturbed <br />area on the map. This was at a distance of 2200 from where the <br />road from the highway entered the disturbed area. Again using a <br />
