Upon the giving of written notice of said <br />desire to the operator, the Staff shall have no more <br />than thirty (30) days to review and comment thereon. <br />If no comments or objections are directed <br />to the operator within thirty (30) days, the plan or <br />program shall be deemed approved. If any such comments <br />or objections are received from the Staff, the operator <br />will be obligated to respond to said comments or objections. <br />The Staff may recommend or suggest revisions of or <br />supplements to said programs or plans. The operator will, <br />however, reserve the sole right to develop the scope <br />and extent of the details of said programs or plans. <br />6(a) The operator will, when expressly required by the application <br />or requested by the Staff, submit proposed monitoring <br />programs, design plans and specifications and plans for <br />reclamation to the Staff Director. <br />The Staff Director, or his designee, shall within seven <br />(7) days of receiving any such documents, notify the <br />operator if the Staff wishes to conduct a detailed <br />review of said submittals. Upon the giving of written <br />~/ notice of said desire to the operator, the Staff shall <br />~v/~\ have no more than thirty (30) days to review and comment <br />thereon. If no comments or objections <br />are directed to the operator within thirty (30) days, <br />the plan or program shall be deemed approved. The Staff <br />may direct the operator to revise or supplement said <br />programs or plans. In cases where the Staff takes such <br />action, the State herein stipulates to its consent <br />to be joined as a party in any action alleging damages to <br />personal property, real property or persons resulting <br />directly or indirectly from said revision or change in <br />any manner whatsoever. <br />~7. Any and'all data or information generated by studies or <br />/~ monitoring by the operator shall be submitted with said <br />f/ operator's annual report. The Staff Director may solicit <br />data or information from specified reports upon request. <br />8. If the rights of any owners of property are determined <br />'~„~,G ~' by final judicial decision to prevent permitted activities <br />~~^_~ ~`~~ on the subject acreage, then the permit will be ineffective <br />,,~?~`, as to those lands. <br />y.,~ <br />9.
