success will be in accordance with that which is presented in 7eb 73, Postmini ng Lend Use
Plan. The area will remain fenced and thus excluded from grazing in the Cressy Creek
drainage until establishment of the vegetation occurs. Because of the soil qualities and
amount of moisture for plant growth, this period should not be more then two years.
Stock Pond Replacement. Prior to operations at Seneca II, stockwaier pond existed on
Grassy Creek in the SEKSY'i, Section 27, T6R, R87Y. In the fall of 1980, this pond was
enlarged to meet the sediment pond design criteria of the Colorado Surface Coal Mining
Reclamation Act. At present, the pond not only serves as a sediment pond but also ~a~
dependable source of water for livestock and wildlife. SCC proposes to leave this pond
after mining with some modifications. Gre ssy Creek will L>e rechanneled to flow through
the pond, the existing culvert will be removed, and the d+am will be Leveled. Basically
whet will remain is a wide depression in Grassy Creek that' will benefit both livestock and
wildlife. All water rights and legal considerations ere consistent with this plan. This
proposal is compatible with the desire to maintain or improve total agricultural
management systems on the property and benefits to wildlife. The sediment pond, as it
will exist after mining, will be a more desirable facility than the premining original
pond for the following reasons: the sediment pond is dug out end contains ground water as .
well es surface water flow end it will contain flow from l:rassy Creek, thus making it a
more dependable water source; the main channel of Grassy l:roek will not be obstructed by a
dam; there will be a larger surface area of water available which will be more attractive
to wildlife; and maintenance by [he postmining operator will. be minimized.

73-2-5 Revised 10/77/94
