Tracy Bennetts
From: Dave.Stahl@UCHSC.edu
Sent: Thursday, June 29, 2006 11:15 AM
To: Tracy Bennetts; Tim Vogel
Cc: Chris Etcheson
Subject: thanks, etc
Dear Tracey & Tim-
Thanks so much for calling me in recent days and keeping me advised of the Joseph Curtis Harden situation. It
sounds like some progress has been made.
At the risk of sounding like a chronic complainer, I want to reiterate my primary concern which I originally
expressed to Clear Creek County government officials last June: the motor oil, antifreeze, gear oil and motor
lubricant contamination on and around Overlooked Way. I believe I had estimated that a minimum of 50 gallons
and perhaps more than 100 gallons of these wastes had been dumped upon the ground of Mr. Harden's property,
Overlooked Way, USFS property and the Mahaney claim. That estimate was based upon the shear volume of
empty or partially empty containers of this type that Mr. Harden was dumped into the semi-dry gulch down slope
of his trailer residence, the large stained regions of soil on these properties and the persistent odor of petroleum
products that emanate from these soils.
I have become increasingly frustrated that nothing has been done about this contamination. It's excessive, it's
unreasonable and it's unacceptable. It must be mitigated if the health and welfare of the people on Overlooked
Way and on Fall River Road is to be protected within the guidelines established by the County of Clear Creek and
the State of Colorado. While the other problems associated with Mr. Harden deserve attention (litter, excrement,
fires, etc), I can think of none other more serious or demanding of immediate action than the soil and ground
water contamination.
If you feel that you cannot make any progress in addressing and mitigating this problem, please say so. I
absolutely need to know what your course of action is in this regard and who I may contact if you believe that you
cannot mitigate the problem. As an aside, I believe that the generator Mr. Harden uses to power his RV is not in
compliance with the new emission standards established by the Colorado State Legislature last year. Given that
Harden's special use permit did not take effect until last summer, I believe he is obliged to adhere to the statutory
requirement and purchase a generator that meets the State's new emission requirements.
Sincerely,
David Stahl
University of Colorado Health Sciences Center
School of Medicine
Surgery/ Urology
4200 East 9th Avenue
Campus Box C319
Denver, CO 80262
Phone: 303-315-3100
FAX: 303-315-7611
Cell: 720-989-6385
7/5/2006
