7. The applicant, in its stability analysis provided in Exhibit S, states that it agrees to a 75 foot <br />setback as to all structures. However, the "notes" section of Exhibit C Mining Plan Map states <br />that Hall-Irwin agrees to a 150 foot setback from wells except that temporary mining can occur <br />within 75 feet of the well on a quarter circle basis, a 40 foot setback from gas lines, and in no <br />event shall mining occur within 75 feet from a production facility. It is insufficient to have the <br />150 foot and other setbacks stated alone in the notes section to a map; these setbacks need to be <br />incorporated into the main body of the permit application. Please address. <br />8. Exhibit C -Mining Plan Map shows the proposed relocation of a gas line and access road <br />conshuction to be completed at the end of Phase 1 Mining. Please verify whether HI has written <br />percussion from the owner of the gas line to relocate the gas line and access road as proposed on <br />the map, or provide the status of any pending agreement between the owner of the gas line and <br />HI. Also, the applicant will need to include the details of the proposed relocation in the narrative <br />of the mine plan. Please address. <br />6.4.5 EXHIBIT E -Reclamation Plan <br />9. The applicant specifies apost-mining land use of developed water resources and lists on page <br />17 that reclamation will include development of three (3) water storage reservoirs. The Division <br />requests that HI provide a geologic evaluation of the floor of the pit, ie: the bottom of the 3 <br />reservoirs, verifying its suitability for permanent water storage; and commit to sealing any <br />undesirable cracks or fissures in the reservoir bottoms during final reclamation. Please respond. <br />10. The applicant indicates on page 17 that trees and shrubs will be planted to create wildlife <br />habitat along the shorelines. In conformance with Rule 6.4.5(2)(e)(iv) please specify the <br />minimum number of each tree and shrub species to be planted along the lake shorelines during <br />final reclamation. <br />11. The applicant indicates on page 18 that reclaimed side slopes will be compatible with MI.RB <br />standards. As a point of clarification, the Division requires of the operator (III), that ao <br />reclaimed slopes shall be steeper than a ratio of 3:1 and reservoir shorelines shall be no steeper <br />than a ratio of 2:1, except from 5 feet above to 10 feet below the expected water line where <br />slopes shall not be steeper than a 3:1 ratio, per Rule 3.1.5(7). Please respond. <br />12. The applicant indicates on page 18 that land shall be revegetated in a manner that establishes <br />a diverse, effective, and long-lasting vegetative cover. The applicant also states on page 19 that <br />the topsoil reapplication thickness will be 6 inches. Upon review of the soil information <br />provided in Exhibit I on page 25, and because 83.2 acres of previously agricultural land will be <br />reclaimed to water surface, there will be a significantly greater depth of topsoil available for <br />reclamation. The Division highly recommends that the applicant commit to reapplying a <br />minimum topsoil depth of at least 18 inches in order that reclaimed slopes, above the reservoir <br />water line, will establish a diverse, effective, and long lasting vegetative cover.
