That the proposed land use does not permit the use of any <br />area containing a commercial mineral deposit in a manner <br />which would interfere with the present or future extraction <br />of such deposit by an extractor. <br />6. That for the above-stated and other reasons, the proposed Use <br />Subject to Special Review is in the best interest of the <br />health, safety, morals, convenience, order, prosperity and <br />welfare of the citizens of E1 Paso County. <br />NOW, THEREFORE, BE IT RESOLVED that the petition of Raymond and <br />Robert Dellacroce for approval of a Use Subject to Special Review <br />to establish a 14.6-acre mineral resource extraction operation <br />(gravel pit) with a 2.4-acre detention pond and 3.0-acre haul <br />road within the proposed A-35 (Agricultural) Zone District in the <br />unincorporated area of E1 Paso County as described in Exhibit A, <br />which is attached hereto and incorporated by reference, be <br />approved; <br />BE ZT FURTHER RESOLVED that the following conditions and <br />notations shall be placed upon this approval: <br />CONDITIONS: <br />1. This operation shall be conducted in accordance with the <br />document entitled, "Application for Mineral and Natural <br />Resource Extraction Operations, Dellacroce Gravel Pit," <br />dated July 6, 1993, and addenda except as otherwise <br />modified by these conditions. All applicable statements <br />included in this document shall be binding upon this <br />operation. <br />2. This approval is contingent upon the applicant obtaining <br />and maintaining compliance with a valid reclamation <br />permit from the Colorado Division of Minerals and <br />Geology. In addition to these conditions, the <br />operation shall be governed by and limited to that <br />permit. Discrepancies between a permit granted by E1 <br />Paso County and a permit granted by the Division of <br />Minerals and Geology may require resolution by the Board <br />of County Commissioners at a public hearing. <br />
