EFFLUENT L~II'I'ATIONS AND MONITORING REQUIREMENTS 2. stormwater Manaeement Plan (SWMP) (continued) 3) A report s~mmari,in the scope of the inspxtion, personnel making the iaspeetion, the daze(s) of the inspection, major observations relating to the implemrntation of the SWMP, and actions taken in accordance with paragraph (b), above, shall be [Wade and retained as part of the SWMP for at least three years. The repon shall be signed in accordance with Part LD.7. of this permit. ` 4) Where semi-annual site inspections are shown in the plan to 6e impractical for sites where an employee is no[ stationed or does no[ routinely visit the site, inspections as required in this part shall be conducted at appropriate intervals specified in the plan, but never less than once in two years. 5) Where semi-annual site inspections are shown in the plan to be impractical for inactive sites (sites where industrial activity is no longer conducted), site inspections required by [his pan shall be conducted at appropriate intervals specified in the plan, but, in no case less than once in three years. At lease one site inspection requited under this pan shall be conducted prior to Oaober 1, 1999, or the dale two years after such site becomes inactive, whichever is earlier. c) Additional SWMP Requirements 1) Signatory Requirements: A copy of the plan shall be signed in accordance with Part I.D.7. and re[ained on site. 2) SWMY Review/Changes: Upon review of the SWMP, the Division may notify the permittee az any time tha[ the plan does no[ meet one or more of the minimum requirements of this permit. After such no[ification, the permi[[ee shall make Changes to the plan and shall submit to the Division an update to the plan including the requested changes. Unless otherwise provided by the Division, the permittee shall have 30 days after such notification to both make the necessary changes to the plan and to implement them. The permittee shall amend the plan whenever there is a change in design, construction, opera[ian, or maintenance which has a significant effect oa the potential for the discharge of pollutanu to the wa[ers of the State, or if the SWMP proves to be ineffective in achieving [he general objxtives of controlling pollutants in stormwater discharges associazed with industrial activity. Amendments [o the plan may be reviewed by the Division in the same moaner as described above. It is the permittee's responsibility to notify the Colorado Division of Mining and Geology (formerly the Mined Land Reclamation Division) of any significan[ changes at their site resulting from the implemrntazion of the SWMP. d) SWMP Availability A copy of the SWMP shall be provided to the Division, the Colorado Division of Mining and Geology (CDMG), and/or to EPA upon request, and within the time frame specified in the request. All SWMPs requited under this permit are considered reports that shall be available to the public under Section 308(b) of the CWA. The owner or operator of a facility with stormwater discharges covered by this permit shall [[take plans available to members of the public upon request. However, the permittee may claim any portion of a stormwaer pollution plan as confidential in accordance with 40 CFR Pan 2. e) Allowable Non-stormwater Discharees The plan shall identity all sources of irrigation return flow and ttatutal uncontaminated spring water that are combined with stormwater discharges associazed with industrial activity. The plan shall identify and ensure the implementation of appropriate measttres to prevent pollution of the non-stormwaer wtnponent(s) of the discharge. Irrigation re[uro flow and natural spring wazer which mixes with mine drainage or process wazer becomes mine drainage or process water.
