EFFLUENT L~II'I'ATIONS AND MONITORING REQUIREMENTS <br />2. stormwater Manaeement Plan (SWMP) (continued) <br />3) A report s~mmari,in the scope of the inspxtion, personnel making the iaspeetion, the daze(s) of the inspection, <br />major observations relating to the implemrntation of the SWMP, and actions taken in accordance with paragraph <br />(b), above, shall be [Wade and retained as part of the SWMP for at least three years. The repon shall be signed <br />in accordance with Part LD.7. of this permit. ` <br />4) Where semi-annual site inspections are shown in the plan to 6e impractical for sites where an employee is no[ <br />stationed or does no[ routinely visit the site, inspections as required in this part shall be conducted at appropriate <br />intervals specified in the plan, but never less than once in two years. <br />5) Where semi-annual site inspections are shown in the plan to be impractical for inactive sites (sites where <br />industrial activity is no longer conducted), site inspections required by [his pan shall be conducted at appropriate <br />intervals specified in the plan, but, in no case less than once in three years. At lease one site inspection <br />requited under this pan shall be conducted prior to Oaober 1, 1999, or the dale two years after such site <br />becomes inactive, whichever is earlier. <br />c) Additional SWMP Requirements <br />1) Signatory Requirements: A copy of the plan shall be signed in accordance with Part I.D.7. and re[ained on <br />site. <br />2) SWMY Review/Changes: Upon review of the SWMP, the Division may notify the permittee az any time tha[ <br />the plan does no[ meet one or more of the minimum requirements of this permit. After such no[ification, the <br />permi[[ee shall make Changes to the plan and shall submit to the Division an update to the plan including the <br />requested changes. Unless otherwise provided by the Division, the permittee shall have 30 days after such <br />notification to both make the necessary changes to the plan and to implement them. <br />The permittee shall amend the plan whenever there is a change in design, construction, opera[ian, or <br />maintenance which has a significant effect oa the potential for the discharge of pollutanu to the wa[ers of the <br />State, or if the SWMP proves to be ineffective in achieving [he general objxtives of controlling pollutants in <br />stormwater discharges associazed with industrial activity. Amendments [o the plan may be reviewed by the <br />Division in the same moaner as described above. <br />It is the permittee's responsibility to notify the Colorado Division of Mining and Geology (formerly the Mined <br />Land Reclamation Division) of any significan[ changes at their site resulting from the implemrntazion of the <br />SWMP. <br />d) SWMP Availability <br />A copy of the SWMP shall be provided to the Division, the Colorado Division of Mining and Geology (CDMG), <br />and/or to EPA upon request, and within the time frame specified in the request. <br />All SWMPs requited under this permit are considered reports that shall be available to the public under Section <br />308(b) of the CWA. The owner or operator of a facility with stormwater discharges covered by this permit shall <br />[[take plans available to members of the public upon request. However, the permittee may claim any portion of a <br />stormwaer pollution plan as confidential in accordance with 40 CFR Pan 2. <br />e) Allowable Non-stormwater Discharees <br />The plan shall identity all sources of irrigation return flow and ttatutal uncontaminated spring water that are <br />combined with stormwater discharges associazed with industrial activity. The plan shall identify and ensure the <br />implementation of appropriate measttres to prevent pollution of the non-stormwaer wtnponent(s) of the discharge. <br />Irrigation re[uro flow and natural spring wazer which mixes with mine drainage or process wazer becomes mine <br />drainage or process water. <br />
