1 <br />GENERAL TERMS AND CONDITIONS: IIMPORTANTI READ ITEMS 8.7 AND 8) <br />1. This permit is issued in reliance upon the accuracy end completeness of information supplied by the applicant end is • <br />conditioned upon conduction of [he activity, or construction, installation and operation of the source, in accordance <br />with this information end with representations made by the applicant or applicant's agents. I[ is valid only for [he <br />equipment end operations or activity specifically identified on the permit. <br />2. Unless specifically stated otherwise, the general end specific conditions contained in this permit have bean determined <br />by the APCD to be necessary to assure compliance with the provisions of Section 2 5-7-1 1 4141181, C.R.S.and, es such, <br />shell be enforceable under the provisions of Section 25-7-115, C.R.S., the Clean Air Ac[, 42 USC Section 7502161131: <br />end Air Queli[y Control Commission Regulation No. 3 Section IV.D.2. or 121 result in an exceedanca of the NAAOS for <br />pollutants es required by Sections 25-7-1051111A1(1) end 20111116), C.R.S., of the Clean Air Act; 42 USC Section <br />74751e1131; end Air Quality Control Commission Regulation No. 3, Section IV.D.1 .c. <br />3. Each end every condition of this permit is a metedal part hereof end is not severable. Any challenge to or aDPeal of, <br />a condition hereof shell constitute a rejection of the entire permit end upon such occurrence, this permit shell 6e <br />deemed denied ab inirio. This permit may be revoked at any time prior to final approval by the Air Pollution Control <br />Division (APCD) on grounds sat forth in the Colorado Air Quality Control Act end regulations of the Air Queliry Control <br />Commission IAQCCI, including failure to meet any express tens or condition of the permit. <br />4. This permit and any required attachments must ha retained and made available far inspection upon request at the <br />location set forth herein. With respect to a portable source which is moved to a new location, a copy of the revised <br />Air Pollutant Emissions Notice IAPENI (required by law to be submitted to the APCD whenever a portable source is <br />relocated) should be attached to this permit. Tha permit may be reissued to a new owner by the APCD es provided <br />in AOCC Regulation No. 3 Section III.B. upon a request for transfer of ownership and the submittal of a revised APEN <br />end the required fee. <br />5. Issuance (initial epprovell of en emission permit does not provide "final" authority for this activity or operation of this <br />source. Final approval of the permit must be secured from the APCD in writing in accordance with the provisions of <br />25-7-114141(j) C.R.S. end AQCC Regulation No. 3, Section IV.H. Final approval cannot be granted until the operation <br />or activity commences end has been verified by the APCD es confonninp in ell respects with the conditions of [he <br />permit. If the APCD so determines, it will provide written documentation of such final approval, which does constitute <br />"final" authority to operate. <br />6. THIS PERMIT AUTOMATICALLY EXPIRES IF you 111 do not commence construction or operation within 18 months <br />attar either the data of issuance of this permit or the date on which such construction or activity was scheduled to <br />commence es se[ forth in the permit, whichever is later; 12) discontinue construction for a period of 18 months or <br />more; or 13) do not complete construction within a reasonable time of [he estimated completion date. Extensions of <br />the expiration data may be granted by the APCD upon a showing of good cause by the permittea. <br />7. YOU MUST notify [he APCD et least thirty days (fifteen days for portable sources) prior to commencement of the <br />permitted operation or activity. Failure to do so is a violation of Section 25-7-114(41(11, C.R.S. end AOCC Regulation <br />No. 3, Section IV.H.1 ., end can result in the revocation of the permit. <br />8. Section 2 5-7-1 1 41511a1. C.R.S, requires that ell sources required to file an Air Pollution Emission Notice (APEN) must <br />pay en annual fee to cover the costs of inspections and administration. If a source or activity is to be discontinued, <br />the owner must notify the Division in writing requesting a cencalletion of the permit. Upon notification, annual fee <br />billing will terminate. <br />9. Violation of the terms of a permit which has received final approval or of the provisions of the Colorado Air Quality <br />Control Act or the regulations of the AQCC may result in administrative, civil or criminal enforcement actions under <br />Sections 25-7-115 (enforcemen[I, -121 (injunctionsl. -1221civil peneltiesl.
