Lessee shall install a cattle guard between the Lessee's <br />adjacent property and the herein demised premises, or totally <br />Eence the affected area from the Lessor's adjacent lands. <br />18. Lessee is hereby given the right to build and maintain a <br />water reservoir at such a place on the herein demised premises <br />as may be selected by the Lessee and to use the water there <br />collected, or water from any stream in or on the demised <br />premises, together with the right to lay and maintain all <br />necessary water lines as may he required by the Lessee in the <br />mining, processing, and removal of aggregate therefrom. <br />19. It is mutually understood and expressly agreed that this <br />instrument embodies the entire agreement of the parties hereto <br />in relation to the subject matter hereof and that no understand- <br />ing or agreements, verbal or otherwise, in relation thereto <br />exist between the parties hereto except as are herein expressly <br />set forth, and that no change or modification of this agreement <br />shall be valid unless set-forth in writing and signed by both <br />the Lessor and the Lessee. <br />20. As part of the consideration for this agreement, it is <br />understood that the Lessee shall have the right to decide when, <br />where, whether, and how to conduct operations hereunder. <br />21. After one calendar year of operations, during the period <br />of this agreement and any extensions thereof, Che royalties as <br />outlined in "Item 5" shall be increased or decreased by the <br />percentage amount of the increase or decrease 'in the "Consumer's <br />Price Index" maintained by the United States Bureau of Labor <br />Statistics, during the preceding year. <br />22.
