I <br />blacked out royalty sections that we do not want part of the <br />public record. I also mark these documents CONFIDENTIAL <br />because I do not want competitors to know our business. I <br />highlighted the section that addresses our continuing right to <br />enter the site for removal of stone. I do not have knowledge <br />of how our access issue was handled between Red Creek Ranch <br />and the State Land Board, but can only assume the state <br />protected their mineral rights. We still pay royalties to the <br />State Land Board so our lease is valid as provided for on Page <br />1 of the lease. If you need more information please let me <br />know. <br />PERMANENT MAN-MADE STRUCTURE <br />As I stated in the permit application we do not expect to <br />adversely affect the structures within 200 feet of the site. <br />Siloam is committed to maintaining the fences if they are <br />impacted. We will not mine closer than 140 feet to a power <br />pole and since the bedrock being mined is very stable we do <br />not expect to affect the road. Mining is currently taking <br />place on the same area under Permit # M-97-O18 and the west <br />side of the permit area is partially mined. At this time <br />there does not appear to be any problems with offsite impacts <br />nor is any intended or anticipated, so I do not believe <br />compensation agreements are necessary for these structures. <br />Thank you for advising us on this matter. <br />I will place a copy of this response, less the lease, with <br />the Pueblo County Clerk and Recorder and send you a copy of a <br />receipt showing it was placed in the record. I have also attached <br />copies of the RETURN RECEIPTS FOR THE ADJOINING LANDOWNERS and a copy of the <br />PROOF OF PUBLICATION to complete the application requirements. I have <br />not received a green card for San Isabel Electric so I am sending <br />a copy of the mail receipt for that notice. You will also find <br /> <br />
