Real property taxes and special 228 <br />assessments, if any, shall be prorated on the basis of the taxes 229 <br />assessed against the described premises for the preceding year. 230 <br />At the time of the closing, Wyoming Fuel shall deliver to the 231 <br />State a check in an amount sufficient to pay all such estimated 232 <br />property taxes and other assessments accrued to the date of clos- 233 <br />ing based on such proration. If the tax lia bility ultimately 234 <br />assessed for the period to date of closing i s greater than such 235 <br />estimated payment, Wyoming Fuel shall within 30 days pay any 236 <br />greater a mount owing. If said tax liability is less than such 238 <br />estimated payment, any refund shall be paid to Wyoming Fuel. <br />15. Title Insurance Policy. Wyoming Fuel shall purchase 242 <br />and pay for a title insurance policy in accord with the above- 243 <br />referenced title insurance commitment to insure title to the Con- 244 <br />servation E asement in Gross to the State in an amount equal to 245 <br />$ and deliver same to the State within 30 days of clos- 246 <br />ing. <br />16. Liability. The State's liability for loss of life, 250 <br />for personal injury, and property damage suffered by any person 251 <br />or persons using the described premises pursuant to this agree- 252 <br />ment shall be as provided in the Colorado Governmental Immunity 253 <br />Act, Sections 24-10-101 to 24-10-120, C.R.S.
