Automatic Coverage: If the appficant does not receive a request for additional information or a notification of denial from the Division dated within thirty days of the receipt of the appliration by the Division, authorization to discharge in accordance with the conditions of this permit shag be dcemed granted. c. Individual Permit Required: If, after evaluation of the application (or additional information, such as the SWMP), it is found that this general permit is not applicable to the operation, then the application wiB be processed as one for m individual permit. The applicant will be notified of the Division's decision to deny certification under this general permit. For an individual permit, additional information may be requested, and 180 days will be required to process the application and issue the permit. Temporary coverage under this generel permit will be allowed until the individual permit goes into effxt. d. General vs. Individual Permit Coverage: Any owner or operator authorised by this permit may request to be excluded from the coverage of this permit by applying for an individual CDPS permit. The owner or operator shall submit an individual application to the Division, with reasons supporting the request. e. Permit Certifications: The individual certification prepared for each applicant will indicate whether Part I.B of the permit which must be followed by that applicant. Part LC mutt be followed by all permittees unless exempted as outlined in Section III.C of the Ratiomle. (In the absence of such indication from the Division, the peratittee will be responsible for determining and then complying with the applicable sections in Part IJ in addition, all nermittees will be required to comply with Part 1, subparts A, D, E and F, and all of Part II of the permit 6. Permit Expiretion Date Authorisation to discharge under this general permit shall commence on October 1, 1992, and shall expire oa September 30, 1997. The Division must evaluate and reissue this general permit once every five years, and must also recertify the applicant's authority to discharge under the general permit at such time. Therefore, any permittee desiring coatiaued coverage under the general permit must reapply by Match 31, 1997. The Division will determine if the applicant may coatiaue to operate under the terms of the general permit. An individual permit will be required for any facility not reauthorized to discharge under the reissued general permit. For facilities wishing to r..,..iner. authorization under the new permit, provisions of Part II.B.S.d will be applicable. 7. Inactivation of Certification The permittce may request inactivation of their certification under this permit, Dace the site has been fully released from their reclamation bond requirements by the Colorado Division of Mining and Geology (CDMG).
