The diversion of water to the Heaton Reservoir under the Rural Ditch shares shall no; <br />exceed 174.5 acre-feet annually and is limited on a monthly basis to the a-ounts shown <br />in column (2) of attached Table 7. Well permits must be obtained for the wells or infiltration galleries in accordance with <br />§37-90-137(2), C.P..S. in conjunction with this plan. Any application will be evaluated <br />subsequent'to approval of this ptan. The provisions of Colorado Revised Statute 37-80- <br />137(2) prohibits the issuance of a permit for a well to be located v/ithin 600 feet of an <br />existing well, unless the state engineer finds that circumstances so warrant after a <br />hearing held in accordance with the procedural rules in 2CCR402-5. This hearing may <br />be waived if you are able to obtain statements from the owners of all wells •:•:ithin 60C <br />feet, verifying that they have no objection to your use of the proposed well. The wells or <br />infiltration galleries must be placed v/ithin 100 foot of the stream system arc may onl <br />divert in priority. <br />6- All diversions into and relezses from Heaton P,eservoir must be measured i^ a manner <br />acceptable to the division engineer and water commissioner. The reservoir must be <br />fitted with a staff gage with a rating curve. All seepage or other unrecorded out of <br />priority inflows must be passed through the reservoir. <br />7. Prior to diversion of water into the Heaton Reservoir, LaFarge shall install and mainta:r <br />such measuring devices and outlet works as required by the division engin»r or water <br />commissioner for administration of this plan. <br />8..
